指定商品役務の範囲

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第9類、第14類、第16類、第25類、第28類、第35類、第38類、第41類及び第42類に属する国際登録において指定された商品及び役務を指定商品及び指定役務として、2000年3月2日にFranceにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2000年(平成12年)8月31日を国際登録の日とするものである。そして、指定商品及び指定役務については、2003年9月26日にされた商品及び役務の限定により、第9類「Nautical,surveying apparatus and instruments(other than for medical use),photographic,cinematographic,optical,weighing,measuring,monitoring(inspection),rescue(emergency)and teaching apparatus and instruments,luminous or mechanical signals;apparatus for recording,transmitting or reproducing sound or images;magnetic recording media,phonographic records;automatic vending machines and mechanisms for coin−operated 2 査定の拒絶理由の要点

原査定は、「本願の指定商品及び指定役務中には、その表示が不明確なものがあるから、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、その指定商品及び指定役務について前記1のとおり限定された結果、本願の指定商品及び指定役務は、商品及び役務の内容が明確なものとなり、商標法第6条第1項の要件を具備するものとなった。

したがって、本願が商標法第6条第1項の要件を具備しないとした原査定の拒絶理由は解消した。

その他、政令で定める期間内に本願を拒絶すべき理由を発見しない。

よって、結論のとおり審決する。
