指定商品の明確性

1 本願商標

本願商標は、「ALIX AVIEN」の欧文字よりなり、第3類及び第5類に属する国際登録において指定された商品を指定商品として、2004年8月25日を事後指定の日とするものである。

そして、指定商品については、2005年12月21日付けで国際登録簿に記録された限定の通報があった結果、第3類「Skin care products,skin care creams,moisturisers,skin protection creams,lip care sticks,skin cleaning products,skin cleaning creams,face masks,make−up remover creams,hair tonics and hair gels,face tonic lotions,toilet soap,bath soap,shaving products,shaving cream and foam,shaving soap,aftershave cream and lotion,shaving gel,sun tanning creams,ultraviolet rays protective creams,suntan oil,self−tanning creams,skin whitening creams,deodorants and anti−perspirant products,depilatory products,mouth and teeth care products,toothpaste,mouth wash,mouth freshening spray,teeth cleaning lotion,bath and shower products,body cleaning products,bath foam,bath oil,bath and shower creams,shower gel,body powder,cream and powder foundation,blusher,make−up powder,lipstick,lip polisher,lip liner,nail polish remover,nail polish,nail hardener,cream eye shadow,powder eye shadow,eyeliner,mascara,hair care products,shampoo,dandruff shampoo,hair conditioner,hair styling gel,brilliantine,hair care cream,hair spray,hair care oil,hair tonic,hair conditioning spray,hair balsam,hair dye,hair bleaching cream,eau de toilette,perfume,body lotion,eau de cologne.」及び第5類「Air freshening preparations,body disinfectant spray.」とされたものである。

2 原査定の拒絶の理由

原査定は、「指定商品は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定商品中、第3類『Care creams,tonic and gel,face tonic,UV filter creams,teeth spray,bath,shower and body cleaning products,lotion.』の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願は、その指定商品について、前記1のとおり限定された結果、商品の内容及び範囲が明確なものになったと認められる。

その結果、本願の指定商品は、商標法第6条第1項の要件を具備するものとなった。

したがって、原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
