指定役務の明確性

1 本願商標

本願商標は、「3D VISIBLE ENTERPRISE」の文字を横書きしてなり、第35類及び第42類に属する国際登録において指定された役務を指定役務として、2004年(平成16年)5月21日を国際登録の日とするものである。

そして、指定役務については、2006年12月27日付けで国際登録簿に記録された限定の通報があった結果、第35類「Business consulting services,namely analyzing data about a company’s strategies,operations and applications and information technology(IT)infrastructures,and using that information to prepare visual models or representations of the company’s business processes,systems and infrastructure(and their interrelationship)in order to allow the company to identify,preview and trace the impact and cost that a proposed business or technology decision will have throughout the company;compilation and systematization of information into a computer database,namely colleting data about a company’s strategies,operations and applications and information technology(IT)infrastructures,and using that information to prepare visual models or representations of the company’s business processes,systems and infrastructure(and their interrelationship)in order to allow the company to identify,preview and trace the impact and cost that a proposed business or technology decision will have throughout the company;business management assistance with implementation of business solutions.」及び第42類「Technology consulting services relating to computer programming and technical research.」とされたものである。

2 原査定の拒絶理由(要旨)

原査定は、「指定役務は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定役務の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願に係る指定役務は、上記1のとおり限定された結果、役務の内容及び範囲が明確なものになり、本願は、商標法第6条第1項の要件を具備するものとなった。

したがって、本願が商標法第6条第1項の要件を具備しないものとした上記2の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
