指定商品の限定

1 本願商標

本願商標は、別掲のとおりの構成からなり、第6類、第9類、第10類及び第14類に属する国際登録において指定された商品を指定商品として、2003年(平成15年)5月6日を国際登録の日とするものである。

そして、指定商品については、2006年6月12日付け及び2007年6月13日付けでそれぞれ国際登録簿に記録された限定の通報があった結果、最終的に、第6類「Common metals and their alloys;metal building materials;transportable buildings of metal;non−electric cables and wires of common metal;metallic pipes and tubes;tubes of plated materials,coated with common metals;tubes of common metals and their alloys coated materials and stainless steels;tubes of expansion alloys;thin−wall tubes of common metals and hardenable copper/beryllium alloys;refined tubes of common metals,stainless steels;washers of metal;buildings of metal;nickel and nickel alloys and steel being straps,wires,tubes and profile sections.」、第9類「Apparatus for recording,transmission and reproduction of sound or images;magnetic media;nautical,electric regulating,surveying,photographic,cinematographic,optical,weighing,measuring,life−saving and teaching apparatus and parts thereof;electric installations for the remote control of industrial operations and parts thereof;luminous or mechanical signals and parts thereof;amplifying tubes;cathodes;frames for optical lenses;hollow waveguides for applications in−high−frequency engineering of copper and copper alloys,invar plated with silver,precious metals and precious metal coatings;capillary tubes for measuring,hydraulics and pneumatics of copper,copper alloys,stainless steels and special alloys;electric contact parts;electric parts for electric or magnetic meters and testers;cold extruded parts as heat sinks;contact parts and contact laminations for collectors;composite electrodes for spark plugs;protective sleeves;composite materials for electrical contacts as fiber and laminar composite materials;tubes as bourdon tubes,bourdon tubes,hollow waveguides.」、第10類、「Surgical,medical,dental and veterinary apparatus and instruments;orthopedic,articles,suture materials,refined tubes of non−ferrous metals and stainless steels for medical purposes;semi−finished products and memory elements of shape−memory alloys for medical purposes;parts,pipes,wires of nickel/titanium(nitinol)for medical purposes;tubes of coated materials,of special alloys and thin−wall for medical purposes;refined and capillary tubes for medical purposes;tubes as bourdon tubes for medical purposes,refined tubes of precious metals for medical purposes.」及び第14類「Precious metals and their alloys and goods in precious metals or coated therewith included in this class.」とされたものである。

2 原査定の拒絶の理由(要旨)

原査定は、「指定商品は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定商品の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願に係る指定商品は、上記1のとおり限定された結果、商品の内容及び範囲が明確なものになり、本願は、商標法第6条第1項の要件を具備するものとなった。

したがって、本願が商標法第6条第1項の要件を具備しないものとした上記2の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
