指定商品の記載の明確性

1 本願商標

本願商標は、「DIEHL CONTROLS」の欧文字を書してなり、第7類、第9類、第11類及び第12類に属する国際登録において指定された商品を指定商品として、2003(平成15年)年2月7日に、第803408号として国際登録されたものである。

その後、指定国を日本とする部分について、2005(平成17年)年9月14日に、国際登録の名義人の変更の記録がなされ、また、その指定商品については、原審における同年9月20日付け限定の通報、当審における2006(平成18年)年7月21日付け限定通報により、同通報に記載されたとおりの商品に限定されたが、前記二つの限定通報については、2007(平成19年)年9月6日付け国際登録簿に関する更正の通報により無効とされ、2006年12月19日付けで国際登録簿に記録された限定通報(我が国への通報は2007年10月29日)により、最終的に第7類「Electric motors,controls for electric motors,dish washing machines,washing apparatus,all the aforementioned goods,in particular for use in domestic appliances and in motor vehicles.」、第9類「Computers;integrated circuits and other electronic circuits(including those recorded with computer programs),frequency converters,power supplies,electromechanical and electronic thermostat controls,wire−connected and wireless electrical remote−action and signal transmission devices,operating knobs and buttons(electric switches)for cooking devices,refrigerators,freezers,washing machines,dish washers,dryers and other household appliances,keyboards,input consoles and other control handles for switch devices of household appliances,liquid crystal displays,LED displays and other displays,touch panels for touch panel devices for cooking devices,refrigerators,freezers,washing machines,dish washers,dryers and other household appliances;solenoid valves,in particular for use in domestic appliances and in motor vehicles.」、第11類「Electrical baking ovens and stoves,heating and cooking appliances,hot plates;coils(parts of heating installation);coil holders(parts of coils of heating installation),radiant heating bodies(parts of heating appliances),refrigerators,freezers,drying appliances,parts of the aforementioned goods,in particular injection−moulded and pressed parts(plastic components).」及び第12類「Plastic injection−moulded and pressed components as motor vehicle parts included in this class.」に限定されたものである。

2 原査定の拒絶の理由(要旨)

原査定は、「指定商品は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定商品中、第7類「Rotary drum and rotary arm drives,pump drives,motor controls,solenoid valves,all the aforementioned goods,in particular for use in domestic appliances and in motor vehicles.」、第9類「Controls for apparatuses which are motor−operated and non−motor−operated,rotary speed regulators,sensors and measuring devices,in particular for weight,water level,rotary speed and for environmental parameters in water and in air such as hardness,salt content,temperature and pressure,time and program controls as well as program switches,operating knobs and buttons,input consoles and other control handles for electromechanical and electronic switch devices,electromechanical and opto−electronic signal and display devices,instrument panels with integrated mountings for switch devices and for control circuits.」及び第11類「cooking vessels and basins,hot plates and heating coils,heating coil holders,radiant heating bodies,appliances for keeping items hot,refrigerating and freezing appliances,rinsing,washing,spin and drying appliances.」は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

原査定において不明確とされた商品については、前記1のとおり限定された結果、商品の内容及び範囲が明確なものになり、本願に係る指定商品は、商標法第6条第1項の要件を具備するものとなった。

したがって、原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
