指定役務の明確性・適法性

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第9類、第35類、第36類及び第41類に属する国際登録において指定された商品及び役務を指定商品及び指定役務として、2005(平成17年)年4月29日にEuropean Communityにおいてした商標登録出願に基づいて、パリ条約第4条による優先権を主張し、同10月28日に国際登録されたものである。

その後、指定商品及び指定役務については、2007(平成19年)年7月13日付で国際登録簿に記録された限定の通報により、同通報に記載されたとおりの役務に限定されたが、同限定通報については、2008(平成20年)年8月21日付の更正通報により無効とされ、最終的に、第41類に属する役務は削除され、第9類「Computer programs and software;computer programs and software relating to finance,investments,pensions and insurance.」、第35類「Systemization of information into computer database,data search in computer files(for others).」及び第36類「Financial services relating to share transactions,financial services relating to trading in financial derivatives;share brokerage,financial services relating to margined transaction trading of share derivatives;financial services relating to contracts for differences;financial consultancy,financial evaluation(insurance,branking,real estate),financial management,all provided over the Internet;financial services provided over the Internet,namely assisting others with the completion of financial transactions for derivatives in stock,bonds,securities and equities,providing on−line stored value accounts in an electronic environment;provision of financial information.」に限定されたものである。

2 原査定の拒絶の理由の要点

原査定は、以下のとおり認定、判断し、本願を拒絶したものである。

(1)本願の指定役務中、第35類「Computer−based storage and retrieval of financial information.」及び第36類「Financial services provided over the Internet.」は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。

(2)本願の指定役務中、第41類「Spread betting services relating to financial derivatives and financial instruments.」は、日本において行うことが認められていない役務である。したがって、本願は、商標法第3条第1項柱書の要件を具備しない。

3 当審の判断

本願の指定役務は、前記1のとおり限定された結果、第35類及び第36類の役務の内容及び範囲が明確になり、かつ、第41類の役務が全て削除された。

したがって、本願が商標法第6条第1項及び同法第3条柱書の要件を具備しないとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
