本願商標は、「KOHERAS SuperK」の文字を書してなり、第9類「Optical,measuring,signalling and checking(supervision)apparatus and instruments in the form of optical light sources based on nonlinear optical media,optical telecommunications hardware,namely optical filters for wavelength division multiplexing,optical switches,fibreoptic components,namely fibre Bragg gratings for optical processing,fibre lasers that act as optical sources in optical telecommunication systems;optical measuring,signalling and checking(supervision)apparatus and instruments,namely optical light guides,namely waveguides in the optical domain,optical fibres,optical fibre lasers,optical fibre gratings in the form of a component based on a periodic variation of the refractive index in optical light guides and used in optical telecommunications for equalisation of optical amplifiers and used in optical sensing as a sensor element,optical fibre sensors used as thermometers and/or strain sensors for wavelength response to changes in temperature and strain;optical fibres and optical fibre components used in telecommunications and optical sensing,namely fibre Bragg gratings,fibre−based WDM networks,fibre−coupled optical isolators,fibre attenuators.」を指定商品として、2005年(平成17年)11月22日に欧州共同体においてした商標出願に基づいてパリ条約第4条による優先権を主張し、2006年(平成18年)4月27日を国際登録の日とするものである。

そして、指定商品及び商品区分については、2008年(平成20年)4月16日付けで国際登録簿に記録された限定の通報があった結果、第9類「Optical and measuring apparatus and instruments in the form of optical light sources based on nonlinear optical media;optical telecommunications hardware,namely optical filters for wavelength division multiplexing,optical switches,diffraction apparatus(microscopy),namely fibre Bragg gratings for optical processing,fibre lasers that act as optical sources in optical telecommunication systems;optical and measuring apparatus and instruments,namely optical light guides and waveguides for high power beam delivery;optical fibres,optical fibre lasers,diffraction apparatus(microscopy),namely optical fibre gratings in the form of a component based on a periodic variation of the refractive index in optical light guides and used in optical telecommunications for equalization of optical amplifiers and used in optical sensing as a sensor element;thermometers and pressure sensors,namely optical fibre sensors used as wavelength response to changes in temperature and strain;optical fibres cables and optical fibre components used in telecommunications and optical sensing,namely fibre Bragg gratings,fibre−based wavelength division multiplexing networks systems;fibre−coupled optical isolators,fibre attenuators.」を指定商品とするものである。

2 原査定の拒絶の理由の要点

原査定は、「指定商品は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定商品中『Optical,measuring,signalling and checking(supervision)apparatus and instruments in the form of optical light sources based on nonlinear optical media,fibreoptic components,namely fibre Bragg gratings for optical processing,optical measuring,signalling and checking(supervision)apparatus and instruments,namely optical light guides,namely waveguides in the optical domain,optical fibre gratings in the form of a component based on a periodic variation of the refractive index in optical light guides and used in optical telecommunications for equalisation of optical amplifiers and used in optical sensing as a sensor element,optical fibre sensors used as thermometers and/or strain sensors for wavelength response to changes in temperature and strain;optical fibres and optical fibre components used in telecommunications and optical sensing,namely fibre Bragg gratings,fibre−based WDM networks.』の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、前記1のとおりその指定商品が限定された結果、商品の内容及び範囲が明確になったものと認められる。よって、本願の指定商品は、商標法第6条第1項の規定の要件を具備するものとなった。

したがって、本願が商標法第6条第1項に該当するとして、本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
