1 本願商標

本願商標は、「WE KNOW WHAT IT TAKES TO BE A TIGER」の欧文字を横書きしてなり、第9類、第16類、第35類、第37類、第41類、第42類及び第45類に属する国際登録において指定された商品及び役務を指定商品及び指定役務として、2006年8月28日にSwitzerlandにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2007年(平成19年)2月28日に国際登録されたものである。

そして、指定商品及び指定役務については、当審において、2009年3月18日に国際登録簿に記録された限定の通報があった結果、第9類「Computer software for designing,installing and executing central computer(mainframe)and user/server programs for integrating financial,manufacturing and sales functions of a business and for managing customer relations and support functions of a business.」、第16類「Pamphlets,books,magazines,reports,newspapers,manuals in the field of business management,information technology and computerized information processing.」第35類「Expert advice relating to business management,administration and consulting in business and marketing processes;mediation of agreements regarding the sale and purchase of goods,namely the purchase of computer hardware and software for third parties;providing business consulting information;business project management;business financial analysis;financial consulting on the acquisition of businesses or participation in business undertakings and business mergers;market analyses;business appraisal particularly cost−price analyses;business monitoring services,namely financial statement preparation and analysis for businesses;business management consulting;economic forecasting and analysis;consulting on business or on personnel matters;drafting of business management reports;computer data entry;organization of exhibitions for economic and promotional purposes in the field of business organisation and management;providing business consulting information.」、第37類「Installation,maintenance and repair services relating to computer hardware systems,computer networks and computer hardware,installation and maintenance of computer equipment.」、第41類「Educational services,namely conducting classes,seminars,workshops and lessons on the development and utilization of software,the use of software,on business affairs and commercial activities,and publication of relevant course materials in connection therewith;organization of exhibitions having an educational objective relating to business management and commercial activities;organisation of conferences;organisation of conferences for economic and promotional purposes relating to business and business management.」、第42類「Installation,implementation,maintenance and repair services relating to computer software;providing information relating to information technology,computers,and computer systems;scientific and technical reserch;advice relating to computers,information systems and computer systems design;design and development of computer systems for third parties;rental of access time to a computer database on business consulting,information technology,computers,computer systems;information technology consulting;computer software design for third parties;computer system design;website design;installation,implementation,maintenance and repair of software;engineering project planning;drawing up of course material on compuer software development and implementation for third parties,namely computer software design.」及び第45類「Mediation(legal services),namely services for mediating business−related conflicts.」と限定されたものである。

2 原査定の拒絶の理由の要点

本願に係る指定商品及び指定役務の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願商標は、商標法第6条第1項の要件を具備しない。

3 当審の判断

本願に係る指定商品及び指定役務については、前記1のとおり補正された結果、商品及び役務の内容及び範囲が明確なものになった。

その結果、本願の指定商品及び指定役務は、商標法第6条第1項の規定の要件を具備するものとなった。

したがって、本願商標が商標法第6条第1項の要件を具備しないとした原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
