指定商品記載の明確性

1 本願商標

本願商標は、「RIDE SHOTS」と欧文字で書してなり、第5類、第29類及び第30類に属する日本国を指定する国際登録において指定された商品を指定商品として、2008年5月21日にSwitzerlandにおいてした商標登録願に基づいてパリ条約第4条による優先権を主張し、2008年(平成20年)11月3日に国際商標登録出願されたものである。その後、指定商品については、当審における2010年(平成22年)3月25日付けで国際登録原簿に記録された限定の通報があった結果、最終的に、第5類「Carbohydrate−based dietetic food preparations adapted for medical purposes;dietetic drinks and foods for medical use;nutritional additives for medical purposes;vitamin−based preparations;mineral food supplements,medicated confectionery .」、第29類「Processed food mainly consisting of proteins and fats combined with vitamins,carbonic hydrates,mineral salts and trace elements in the form of tablets,capsules,liquids or powders(for non−medical purposes),protein preparations for human consumption;energy bars,namely processed food mainly consisting of protein in the form of bars.」及び第30類「Confectionery items,sugar confectionery,mixture of jellified and sugar−coated confectionery goods,sweets,flavoured gums;cereal preparations,cereal−based snacks(confectionery);ready−to−eat cereal bars made with cereals and grains;cereal preparations,namely cereal energy bars;rice snacks(confectionery);bars and preparations made from wheat;processed food based on carbohydrates in the form of tablets,capsules,liquids or powders(for non−medical purposes);processed food based on carbohydrates in the form of tablets,capsules,liquids or powders for foodstuffs(for non−medical purposes).」となったものである。

2 原査定の拒絶の理由の要点

原査定は、「本願商標の指定商品に係る商品の表示は、その内容及び範囲を明確に表したものとは認められない。したがって、本願商標は、商標法第6条第1項に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標の指定商品は、前記1のとおり限定された結果、その内容及び範囲は明確なものになったと認められる。

したがって、本願商標が商標法第6条第1項に該当するとして本願を拒絶した原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
