国際商標の指定商品役務の適否

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第7類、第9類及び第40類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2008年10月24日にフランス国においてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2009年(平成21年)4月24日に国際商標登録出願されたものである。

その後、指定商品及び指定役務については、当審における2010年(平成22年)12月10日付けで国際登録簿に記録された限定の通報があった結果、最終的に、第7類「Motors and engines other than for land vehicles and electric generators;spare parts for the aforementioned machines;systems for transforming electrical energy into mechanical energy,namely motors and engines (other than for land vehicles) and fuel converters;apparatus and instruments for conducting,switching,transforming,accumulating,regulating or controlling any other form of energy than electrical energy,namely motors and engines (other than for land vehicles) and fuel converters.」、第9類「Apparatus and instruments for conducting,switching,transforming,accumulating,regulating or controlling electricity;apparatus and instruments for conducting,switching,transforming,accumulating,regulating or controlling any form of energy other than electrical energy including mechanical energy,namely electrical transformers,and converters;apparatus and instruments for conducting,switching,transforming,accumulating,regulating or controlling all kinds of renewable energy,namely geothermal energy,hydraulic energy,wind energy;electricity conduits,transformers,electric switches,circuit breakers,fuses,voltage surge suppressors;relays;reactive power compensators;condensers (capacitors),electric coils,electric converters and inverters;electric meters,electronic components;semiconductors;printed circuits;electric conductors;communication and power wires and cables;circuit boards,electrical control panels,decentralised power production stations,including for renewable energy,namely distribution consoles (electricity);high−voltage equipment for converting energy,namely,circuit breakers,isolating switches,lightning arresters,dividers of all types and for all types of voltage (including optoelectronic) for inside and outside boxes or boxes within metallic cases (metal−clad boxes);medium and low−voltage equipment for converting energy,namely,switches,isolating switches,contactors,lightning arresters,circuit breakers,fuses;transformers,sockets,plugs and other contacts (electric connections);commutators;junction boxes;circuit breakers,static and rotary converters;energy converters;electrical resistors;rheostats;capacitors,magnets;electric conductors of all types of metal;relays,namely remote controlled relays,electric relays.」及び第40類「Production (generation) of energy;production (generation) of energy by using natural elements (sun,water,wind);information and advice on the production (generation) of energy for third parties;information and advice on installations for production (generation) of energy,namely electricity,gas and water.」とされた。

2 原査定の拒絶の理由の要点

原査定は、本願の指定商品及び指定役務は、その内容及び範囲を明確に指定したものとは認められないから、本願は商標法第6条第1項の要件を具備しない旨認定、判断した。

3 当審の判断

本願に係る指定商品及び指定役務は、前記1のとおり限定された結果、その内容及び範囲が明確なものになった。

したがって、本願が商標法第6条第1項の要件を具備しないとした原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
