地名と記述的称呼の識別力

1 本願商標

本願商標は、「WIENER SYMPHONIKER」の欧文字を書してなり、第9類、第16類及び第41類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2014年(平成26年)5月12日に国際商標登録出願されたものである。

その後、指定商品及び指定役務については、原審における平成27年5月8日付けの手続補正書及び2016年(平成28年)11月28日付けで国際登録簿に記録された限定の通報があった結果、第9類「Apparatus for recording of sound or images;apparatus for transmission and reproduction of sound or images,in particular CDs,digital versatile discs,video cassettes;floppy disks,videotapes,video cassettes,video game cartridges,sound recording apparatus,sound recording strips,tape recorders,sound locating instruments,magnetic data carriers,magneto−optical and optical data carriers.」、第16類「Paper,boxes of paper,table cloths of paper,table napkins of paper,cardboard and cardboard articles;in particular towels of paper,table napkins of paper,filter paper,handkerchiefs of paper,party decorations of paper,packaging containers of paper,paper bags for packaging and wrapping,writing paper;printed matter,in particular programmes,pamphlets,magazine,newspapers,periodicals,calendars,song books,coffee table books,cards,posters,signs and placards of paper or cardboard,transparencies(stationery);tickets,entry tickets,invitation cards,postcards,non−encoded identity cards;packaging materials made of plastic,not included in other classes,in particular sleeves,pouches,bags,engravings;photographs;stationery,in particular ball−point pens,fountain pens,pencils.」及び第41類「Reference libraries of literature and documentary records;in particular orchestras,performance of music and orchestra services;conducting concerts,theatre and entertainment events;rental of concert halls for cultural and entertainment purposes;organization,production,presentation and conducting of orchestra,seating reservations for concert,theatrical and entertainment events;organization and conducting of concerts,theatre and entertainment events; publication of text,graphics,image and sound data which can be transmitted electronically via data networks;online providing of electronic,non−downloadable publications,online publication of electronic books and periodicals;education and providing of training in connection with the aforesaid services.」とされたものである。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、オーストリア・ウィーンに本拠を置くオーケストラとして著名な『WIENER SYMPHONIKER』の文字を普通に用いられる態様で書してなるところ、これを本願の指定商品及び指定役務中、第9類『downloadable image files,phonograph records;downloadable music files;Audio and video recordings.』及び第41類『rental of sound and image recordings;』との関係において、前記オーケストラである『WIENER SYMPHONIKER』の演奏やその映像が収録された商品又はそのような商品の貸与に使用するときは、単に商品の品質又は役務の質(内容)を表示するものである。したがって、本願商標は、商標法第3条第1項第3号に該当し、前記商品及び役務以外の商品及び役務に使用するときは、商品の品質及び役務の質の誤認を生じさせるおそれがあるので、商標法第4条第1項第16号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願の指定商品及び指定役務は、前記1のとおり限定された結果、原査定における拒絶の理由に係る指定商品及び指定役務はすべて削除されたものと認められる。

したがって、本願商標が商標法第3条第1項第3号及び同法第4条第1項第16号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
