指定商品の明確性

1 本願商標

本願商標は,別掲のとおりの構成よりなり,第3類に属する日本国を指定する国際登録において指定された商品を指定商品として,2017年(平成29年)4月26日に国際商標登録出願されたものである。

2 原査定の拒絶の理由の要点

原査定は,「本願は,その指定商品中に,商品の内容及び範囲を明確に指定したものとは認められないものを含むものであるから,商標法第6条第1項の要件を具備しない。」旨認定,判断し,本願を拒絶したものである。

3 当審の判断

本願の指定商品は,上記1のとおりの商品に限定された結果,本願は,商品の内容及び範囲が明確なものになったと認められる。

したがって,本願が商標法第6条第1項の要件を具備しないとして本願を拒絶した原査定の拒絶の理由は,解消した。

その他,本願について拒絶の理由を発見しない。

よって,結論のとおり審決する。
