簡単かつありふれた標章の識別力

本願商標は、別掲のとおりの構成からなり、第9類及び第35類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2016年(平成28年)12月14日に国際商標登録出願されたものであり、その後、本願の指定商品及び指定役務については、当審における2018年10月1日に国際登録簿に記録された取消の通報があった結果、第9類「Computer software for wireless content delivery;computer application software for mobile phones,namely,software that allows users to perform electronic e−commerce shopping transactions;computer e−commerce software to allow users to perform electronic business transactions via a global computer network;proximity sensors;computer application software for mobile phones,namely,software that allows users to perform electronic e−commerce shopping transactions,to track rewards and incentive program points that are earned from shopping online and at retail stores,and to enhance the user’s shopping experience by directing the user to specific deals,discounts,recommendations and rewards within retail store locations and on online retail store websites;computer software for facilitating transactions,namely,an electronic financial platform that accommodates multiple types of payment and debt transactions in an integrated mobile phone,PDA,and web based environment.」及び第35類「Advertising and marketing;advertising and promotional services;electronic commerce services,namely,providing information about products via telecommunication networks for advertising and sales purposes;promoting the sale of goods and services of others by means of contests and incentive award programs;customer loyalty services and customer club services,for commercial,promotional and/or advertising purposes.」とされたものである。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、青色の四角形内に白色の『S』の文字を配してなるところ、「S」の文字は、頭文字、記号、略語又は商品・サービスコードであると広く認識されており、また、四角形も極めて簡単でありふれているものであるため、ローマ字1字と簡単な図形の組合せからなる本願商標は、極めて簡単で、かつ、ありふれた標章のみからなる標章である。したがって、本願商標は、商標法第3条第1項第5号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、別掲のとおり、青色で塗りつぶした輪郭のない隅丸正方形の中央に、始点と終点を垂直にし、白抜きの太線で表された「S」字状のものを配した構成からなるものである。

そして、本願商標は、青色の輪郭のない背景に対して、白抜きの「S」字状のものを際立たせる色彩の組合せ方や、太線で表された「S」字状のものが、隅丸正方形の中央にバランスよく表されてなる構成態様から、その構成全体が極めてまとまりのよいものとして印象付けられるものといえる。

そうすると、本願商標は、全体として一体的に構成された特色のある図形商標であると認識されるとみるのが相当であり、極めて簡単で、かつ、ありふれた標章のみからなる商標とはいえないものである。

したがって、本願商標が商標法第3条第1項第5号に該当するとして、本願を拒絶した原査定は、取消しを免れない。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
