1 本願商標

本願商標は、別掲のとおりの構成からなり、第35類、第38類、第42類及び第45類に属する日本国を指定する国際登録において指定された役務を指定役務として、2018年2月5日にSwitzerlandにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2018年(平成30年)2月9日に国際商標登録出願され、その後、指定役務については、2019年(令和元年)12月27日付けで国際登録原簿に記録された限定の通報があった結果、第35類「Commercial risk assessment services;computer data processing services;office functions in the field of data processing;business networking services,namely,business management,and planning,arrangement,management and organization of business meetings for facilitating business networking;advertising services;presentation of companies on the Internet and other media;computerized file management services;services provided by consultants and advisory services in the field of business strategy;services provided by consultants regarding company management;marketing assistance services;administrative services for the acceptance and implementation of orders;business administration services;provision of business information directory services via global computer networks;provision of advice and services provided by consultants relating to company strategy.」、第38類「Data transmission services;consultancy services in the field of telecommunication;services provided by consultants relating to data communication;consultancy,information and advisory services in the field of telecommunications;telecommunications;provision of access to databases;provision of access to databases and information via global computer networks;provision of access to information via data networks;provision of on−line access to databases;automatic transmission of digital data via telecommunications channels.」、第42類「Quality control services for certification purposes;quality control testing of products for certification purposes;test services for quality or standard certification;monitoring of computer systems for the detection of unauthorized access or data protection breaches;computer security services for protection against unauthorized network access;testing,analysis and evaluation of products and services of others with a view to their certification;testing of apparatus in the field of electrical engineering for certification purposes.」及び第45類「Provision of legal advice;provision of expert legal opinions;provision of reconnaissance and surveillance services;mediation in the framework of legal procedures;exploitation of industrial property rights and copyrights by licensing(legal services);registration of domain names on a global computer network for the identification of users(legal services);authentication of personal identification information(identity verification services);legal services;security services for the protection of property and individuals;services provided by consultants and legal services in the field of laws,regulations and requirements regarding confidentiality and security.」とされたものである。

2 原査定の拒絶の理由の要点

原査定は、「本願は、役務の内容及び範囲が不明確な指定役務の表示を含むものであるから、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願は、その指定役務について、前記1のとおり限定された結果、役務の内容及び範囲が明確なものになったと認められるから、商標法第6条第1項の規定の要件を具備するものとなった。

したがって、原査定の拒絶の理由は、解消した。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
