2 補正の適否

(1)補正の目的要件

本件補正は、「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記ストッパーと前記気管チューブの先端面との当接により規制されている」との事項において、「前記気管チューブの先端面」を「前記気管チューブの

近位端の

面」と限定し、これに伴い、「位置が調整された前記ストッパーと」当接すると特定していたものを「位置が調整された前記ストッパー

の前記気管チューブの近位端の面に対向する端面

」と、気管チューブとストッパーの当接する位置をさらに特定したものである。

これは全体として、ストッパーと気管チューブの当接の関係を限定する補正であり、本件補正の前後で産業上の利用分野及び解決しようとする課題は同一であるから、特許請求の範囲の減縮を目的とする補正に該当し、特許法第17条の2第5項第2号に規定された事項を目的とするものである。

本件補正は、特許請求の範囲の減縮を目的とする補正を含むものであるから、本件補正後の特許請求の範囲に記載されている事項により特定される発明(本件補正発明)が、特許法第17条の2第6項で準用する同法第126条第7項の規定に適合するか否か、すなわち、特許出願の際に独立して特許を受けることができるものか否かについて検討する。

According to one embodiment of the present invention, the scope is adapted to be used with an endotracheal tube during orotracheal intubation that includes a module for manipulating the intubating scope. According to various embodiments, the present invention discloses a scope, such as a scope for performing intubation of a patient's airway, which is adapted to be used with an endotracheal tube during orotracheal intubation is provided that includes a module for manipulating the intubating scope. The module includes an illumination source, an image sensor, a power source, and a viewing member. Further,

Referring to FIG. 1, a device according to one embodiment of the present disclosure is shown in a perspective view. The device in this embodiment comprises an ETT 4 for facilitating intubating a patient, and to ensure that the patient's airway is not closed off such that air is unable to reach the patient's lungs. The cuff 20 is inflatable and is provided to form a seal with the wall of the trachea during intubation when inflated. Nozzle 28 connects the tube 24 to an inflation device (not shown). It will be appreciated that other image sensor technology, such as a complementary metal-oxide-semiconductor (CMOS) chip, are also within the scope of the present invention.

A display screen 84, such as an LCD screen, is mounted to the module 48 and connected to the image sensor 81 via internal circuitry (not shown) to allow an operator to view the images received by the image sensor 81. The display screen 84 can be mounted in any way known in the art, and is preferably adjustable to provide a convenient viewing orientation regardless of the position of the module. In addition, the module can include an eyepiece 42 for allowing viewing of an image received by the image sensor 81. Additionally, an image-receiving port (not shown) may be provided in the module 48 and connected to the image sensor 81 via internal circuitry (not shown) to allow images to be transferred to an external device, such as a computer, for instance. Furthermore, a power source 46 provides power to the electrical components of the intubating scope 44. An on/off switch (not shown) may be provided to control supply of power from the power source 46 to the various electrical components.

Once the stylet 52 has been sufficiently advanced, images may be viewed from the imager of the stylet 52, which have been transmitted wirelessly to the video display 102, and which are not directly visible to the user.

According to one embodiment of the present invention, a method for intubating a patient 112 is described which generally comprises the following steps. Initially, a wireless video stylet 52 is inserted into the lumen of the ETT 4. In one embodiment of the present invention, the proximal end of the stylet includes a mechanism to position the distal end of the stylet slightly proximal to the distal end of the ETT. Once the stylet and ETT have been prepared accordingly, a wireless display 102 may be selectively positioned by the user. By doing so, the user may then insert the ETT into the tracheal inlet using the information and feedback provided by the display or by direct observation of the tracheal inlet, or both. Next, the user removes the laryngoscope blade 101 from the patient and guides the ETT 4 into trachea while removing the video stylet simultaneously. The patient is now intubated and a cuff on the ETT 4 may now be employed to create a seal for mechanical or spontaneous ventilation.

以上より、まず、引用文献1には、

an improved introducing stylet, also known as an intubation assembly rod, configured to have an endotracheal tube (ETT) carried thereon.

[002] Conventional endotracheal intubation is a three- step procedure including: (1) tissue retraction and separation, (2) vocal cord identification and visualization, and (3) endotracheal tube positioning, delivery, and passage.

Stiff, rigid, and potentially traumatic stylets are frequently shaped and placed within the endotracheal tube, to give more control and guidance to the endotracheal tube tip in the direction of the visualized vocal cords. However, once the rigid stylet has been manually shaped, the user must work with that specific curvature and shape. オ 当審の判断

(ア) 対比

本件補正発明と引用発明とを対比する。

引用発明の「喉頭鏡ブレード」は、本件補正発明の「喉頭内視鏡」に相当する。

引用発明の「挿管スコープ」は、後記するように、その構成要素がそれぞれ対応することから、本件補正発明の「内視鏡ガイドコア」に相当する。

引用発明の「前記喉頭鏡ブレードの使用者は空いている手で前記挿管スコープの前記スタイレットを患者の口腔内に挿入する」との事項により、使用者は気管挿管を行う時に喉頭鏡ブレードと挿管スコープをそれぞれ、片手で持つものと解される。また、挿管スコープの「前記スタイレットを気管挿管チューブ(ETT)に挿入」するものであるから、挿管スコープのスタイレットには挿管チューブが被覆されているものである。してみれば、引用発明の「挿管スコープと喉頭鏡ブレードからなるもの」は、後記する相違点を除いて、本件補正発明の「喉頭内視鏡と内視鏡ガイドコアを含み、喉頭内視鏡と内視鏡ガイドコアは、気管挿管を行う時に喉頭内視鏡を片手で持ち、内視鏡ガイドコアに被覆された気管チューブを他手で持つように、2つの別々の部材であり」に対応する。また、本件補正発明の「気管挿管セット」に対応する。

引用発明の「前記喉頭鏡ブレードは」、「別体の前記挿管スコープのイメージャから取得された画像を無線伝送によって表示するために用いる着脱可能なビデオディスプレイを備え」、「ハンドルはビデオディスプレイを受けるように適合され」、及び、「前記喉頭鏡ブレードは前記挿管スコープのレンズから前記ビデオディスプレイへ画像を送信するための無線ビデオ受信チップを含み」との事項と、本件補正発明の「ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定されるか又はWiFi(登録商標)又はブルートゥース(登録商標)の無線装置により喉頭内視鏡と接続されて画像伝送を行い、内視鏡ガイドコアとディスプレイは、データライン又はWiFi又はブルートゥースの無線装置により接続されて画像伝送を行い」とに関し、まず、引用発明の「別体の前記挿管スコープのイメージャから取得された画像を無線伝送によって表示するために用いる着脱可能なビデオディスプレイを備え」及び「ハンドルはビデオディスプレイを受けるように適合され」との事項は、少なくとも、前記ビデオディスプレイは前記喉頭鏡ブレードのハンドルに固定し得るものと解されるから、引用発明と本件補正発明とでは「ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定される」点で共通すると解される。

次に、引用発明の「前記喉頭鏡ブレードは前記挿管スコープのレンズから前記ビデオディスプレイへ画像を送信するための無線ビデオ受信チップを含み」との事項から、ビデオディスプレイは無線装置により前記喉頭鏡ブレードの無線ビデオ受信チップと接続して画像伝送を行うものと解されるから、引用発明と、本件補正発明の「ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定されるか又はWiFi(登録商標)又はブルートゥース(登録商標)の無線装置により喉頭内視鏡と接続されて画像伝送を行い」とでは、前記共通点とあわせて、「ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定されるか又は無線装置により喉頭内視鏡と接続されて画像伝送を行」うとの点で共通し、後記する相違点で相違する。また、引用発明の前記摘記事項より、前記挿管スコープのレンズと前記ビデオディスプレイは、前記喉頭鏡ブレードの無線ビデオ受信チップを介して、無線接続されるものと解されるから、引用発明と本件補正発明の「内視鏡ガイドコアとディスプレイは、データライン又はWiFi又はブルートゥースの無線装置により接続されて画像伝送を行い」とでは、「データライン又はWiFi又はブルートゥースの無線装置により接続されて」は択一的な記載であるから、「内視鏡ガイドコアとディスプレイは、データライン又は無線装置により接続されて画像伝送を行」う点で一致し、後記する相違点で相違する。

引用発明の「挿管スコープ」の「前記挿管スコープを操作するためのモジュール」は、本件補正発明の「喉頭内視鏡ハンドル」に相当する。

引用発明の「挿管スコープ」の「第一端で前記モジュールに接続され内部に少なくとも一本の内腔を有するスタイレット」は、本件補正発明の内視鏡ガイドコアの「前記喉頭内視鏡ハンドルと接続された中空チューブ」に相当する。

引用発明の「モジュールによって操作可能であり、画像センサーが配置された可撓性先端部」における「画像センサー」は「前記中空チューブの前記喉頭内視鏡ハンドルから離間する端部に設けられた撮像装置」に相当する。

引用発明の「スタイレットを挿管チューブ(ETT)に挿入し、挿管スコープをETTに着脱可能に固定するために使用され、スタイレットの外表面に沿ってスライド可能であり、ETTの近位端を摩擦で受け入れるように設計されたコネクタ」と、本件補正発明の「前記中空チューブの延在方向に沿って位置調整可能に前記中空チューブの外周面に嵌着された環状のストッパ」及び「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記ストッパの前記気管チューブの近位端の面に対向する端面と前記気管チューブの近位端の面との当接により規制されている」とでは、後記する相違点を除き「前記中空チューブの延在方向に沿って位置調整可能に前記中空チューブの外周面に嵌着された環状の部材」であって、「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記部材により規制されている」との点で共通する。

(イ) 一致点及び相違点

してみれば、本願発明と引用発明とでは、以下の点で一致及び相違する。

喉頭内視鏡と内視鏡ガイドコアを含み、喉頭内視鏡と内視鏡ガイドコアは、気管挿管を行う時に喉頭内視鏡を片手で持ち、内視鏡ガイドコアに被覆された気管チューブを他手で持つように、2つの別々の部材であり、ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定されるか又は無線装置により喉頭内視鏡と接続されて画像伝送を行い、内視鏡ガイドコアとディスプレイは、無線装置により接続されて画像伝送を行い、ディスプレイは、喉頭内視鏡の一部として、喉頭内視鏡ハンドルに固定されるか又は無線装置により喉頭内視鏡と接続されて画像伝送を行い、内視鏡ガイドコアとディスプレイは、データライン又は無線装置により接続されて画像伝送を行い、

[相違点1]

無線装置に関し、本件補正発明は「WiFi(登録商標)又はブルートゥース(登録商標)の無線装置」であるのに対し、引用発明は無線伝送を行うことは特定しているものの、WiFiやブルートゥースといったその具体的な規格については、特定はない点。

[相違点2]

「環状の部材」に関し、本件補正発明は「前記中空チューブの延在方向に沿って位置調整可能に前記中空チューブの外周面に嵌着された環状のストッパ」であって、「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記ストッパの前記気管チューブの近位端の面に対向する端面と前記気管チューブの近位端の面との当接により規制されている」のに対し、引用発明では、「前記スタイレットを挿管チューブ(ETT)に挿入し、前記挿管スコープを前記ETTに着脱可能に固定するために使用され、前記スタイレットの外表面に沿ってスライド可能であり、前記ETTの近位端を摩擦で受け入れるように設計されたコネクタ」である点。

(ウ) 判断

前記相違点について検討する。

a 相違点1について

前記引用文献3記載技術は、本件補正発明と同様に気管挿管に用いる内視鏡に係る技術であって、前記気管挿管チューブ挿入装置は、光学アセンブリを含み、無線通信機能として、Wi-Fi及びBluetooth機能を備えることが特定されている。よって、引用発明の無線伝送として、当該技術を適用しWiFi及びブルートゥースを採用し、「WiFi(登録商標)又はブルートゥース(登録商標)の無線装置」とすることは、当業者が容易になし得た事項である。

b 相違点2について

前記引用文献4記載技術は、本件補正発明と同様に前記気管チューブに差し込まれた挿入管の差し込み量を、挿管チューブの基端面とストッパとの当接により規制することが特定されている。よって、引用発明に当該技術を適用し、引用発明の前記ETTの近位端を摩擦で受け入れるように設計されたコネクタに代え、「前記ストッパの前記気管チューブの近位端の面に対向する端面と前記気管チューブの近位端の面との当接により規制」することは、当業者が容易に想到することができた事項である。

(エ)請求人の主張について

請求人は、審判請求書において、以下の点を主張している。

「しかしながら、引用文献4に記載の発明(以下、単に引用発明4ともいう)では、ストッパ手段は、挿入管1a,1bが挿入された支持筒部21と、支持筒部21の外周に装着されたストッパ22と、ストッパ22を支持筒部21に固定するための固定用手動ネジ23と、から構成されている(段落0011及び図6,7参照)。また、引用発明4では、「挿入管1a,1b」は、両端がそれぞれ把持部20及び先端部本体10と接続されているため、本願発明1の「中空チューブ」に相当する思料する。すると、引用文献4の「支持筒部21」は、中空チューブに相当する挿入管1a,1bの外周面に設けられているものである。さらに、引用文献4の「支持筒部21」は、明らかに挿入管1a,1bよりも短いため、ストッパ22の調整範囲が支持筒部21の長さによって大幅に制限されてしまうことになる。

これに対し、本願発明1では、ストッパは、中空チューブの外周面に嵌着された環状のストッパであるため、引用発明4に比べ、支持筒部21及び固定用手動ネジ23を必要とせず、ストッパの構成の簡易化を図ることができるとともにストッパの調整範囲が大幅に制限されてしまうことがない。

よって、引用文献4には、上記相違点に係る本願発明1の事項が記載又は示唆されているとは認められない。」

しかしながら、引用発明のコネクタは、前記(ア)で検討したとおり、「前記スタイレットの外表面に沿ってスライド可能であり」、引用発明のスタイレット(本件補正発明の「中空チューブ」に相当)の外周面に嵌着された環状の部材と認められる。そして、前記(ウ)bのとおり、引用発明に引用文献4記載技術を適用することにより、引用発明の前記ETTの近位端を摩擦で受け入れるように設計されたコネクタに代え、「前記ストッパの前記気管チューブの近位端の面に対向する端面と前記気管チューブの近位端の面との当接により規制」することは、当業者が容易に想到することができた事項である。ここで、引用文献4記載技術が本件補正発明と相違し、「ストッパ22がスライド自在に取り付けられた支持筒部21を介して把持部20に連結されて」いるものであったとしても、引用文献4に記載された「挿管チューブ100の基端面がストッパ22に当接」する技術思想を引用発明に適用することに阻害要因はなく、むしろ技術分野の近接性から前記適用することに動機付けがあったというべきである。

また、請求人の主張する「この発明によれば、気管チューブに対する中空チューブの過剰の差し込みを位置が調整された環状のストッパの気管チューブの近位端の面に対向する端面と気管チューブの近位端の面との当接により抑制することができるため、ストッパの構成の簡易化を図るとともに気管チューブの端面と中空チューブの端面との間の距離を確実に保持することができるという優れた効果が得られる」との効果も、引用発明及び引用文献4記載技術から当業者が予測できる範囲内である。

カ 本件補正発明の独立特許要件についてのまとめ

以上のとおり、本件補正発明は、引用文献1に記載された発明、引用文献3,4に記載された技術に基づいて当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により特許出願の際独立して特許を受けることができない。

キ 本件補正についてのまとめ

したがって、本件補正は、特許法第17条の2第6項で準用する同法第126条第7項の規定に違反するので、同法第159条第1項の規定において読み替えて準用する同法第53条第1項の規定により却下すべきものである。

よって、前記補正の却下の結論のとおり決定する。

第3 本願発明について

1 本願発明

令和6年9月18日にされた手続補正は、前記のとおり却下されたので、本願の請求項1~2に係る発明は、令和6年2月21日にされた手続補正により補正された特許請求の範囲の請求項1~2に記載された事項により特定されるものであるところ、その請求項1に係る発明(本願発明)は、その請求項1に記載された事項により特定される、前記第2の1に記載のとおりのものである。

2 原査定の拒絶の理由の概要

請求項1についての原査定の拒絶の理由は、前記第2の2(2)アに記載したとおりである。

3 対比・判断

前記第2の2(1)で検討したとおり、本件補正発明は、本願発明を限定するものであるから、本願発明と引用発明の一致点は、前記第2の2オ(イ)のとおりであり、相違点は以下のとおりである。

[相違点1]

無線装置に関し、本願発明は「WiFi(登録商標)又はブルートゥース(登録商標)の無線装置」であるのに対し、引用発明は無線伝送を行うことは特定しているものの、そのWiFiやブルートゥースといった規格については、特に特定はない点。

[相違点2]

「環状の部材」に関し、本願発明は「前記中空チューブの延在方向に沿って位置調整可能に前記中空チューブの外周面に嵌着された環状のストッパ」であって、「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記ストッパと前記気管チューブの先端面との当接により規制されている」のに対し、引用発明では、「前記スタイレットを挿管チューブ(ETT)に挿入し、前記挿管スコープを前記ETTに着脱可能に固定するために使用され、前記スタイレットの外表面に沿ってスライド可能であり、前記ETTの近位端を摩擦で受け入れるように設計されたコネクタ」である点。

相違点1に係る事項は、前記第2の2(2)オ(ウ)aでの検討と同様であり、引用発明及び引用文献3記載技術に基づき、当業者が容易に想到することができた事項である。

相違点2に係る事項は、前記第2の2(2)オ(ウ)bでの検討と同様であり、「前記気管チューブに差し込まれた前記中空チューブの前記端部の差し込み量は、位置が調整された前記ストッパと前記気管チューブの先端面との当接により規制されている」との事項は、引用発明に引用文献4記載技術を適用することにより、当業者が容易に想到することができたものである。

してみれば、本願発明は、引用発明及び引用文献3、4記載技術に基づき、当業者が容易に発明をすることができたものである。

第4 むすび

以上のとおり、本願発明は、引用文献1に記載された発明及び引用文献3、4に記載された技術に基づき、当業者が容易に発明をすることができたものであるから、特許法第29条第2項の規定により、特許を受けることができない。

したがって、本願は、他の請求項について検討するまでもなく、拒絶すべきものである。

よって、結論のとおり審決する。
