指定役務の類似性

1 本願商標

本願商標は、「TRIST」の欧文字を横書きしてなり、第1類、第5類、第10類及び第42類に属する国際登録において指定された商品及び役務を指定商品及び指定役務として、2007年2月6日にUnited Kingdomにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2007年(平成19年)6月14日に国際登録されたものである。

そして、指定商品及び指定役務については、原審における平成20年10月8日付け手続補正書及び当審における、2009年4月14日に国際登録簿に記録された限定の通報があった結果、第1類「Chemical products for use in industry;chemical preparations for scientific purposes(other than for medical or veterinary use);enzymes;chemical products for in−vitro use in laboratories and for analysis;micro−organisms,cell cultures,plasmids and cultures of micro organisms,deoxyribonucleic acid sequences,cloning vehicles,namely chemical products for use in biotechnology,research and development and recombinant deoxyribonucleic acid variations thereof,all for in−vivo use.」、第5類「Gene therapy and prophylaxis pharmaceutical preparations for the treatment of cancer;pharmaceutical substances and preparations;vaccines,enzymes and enzyme preparations,pharmaceuticals for the delivery of genes to muscle cells,all for medical purposes;hypoxia response pharmaceutical substances and preparations,viral and retroviral vectors,viral and retroviral vector manufacturing preparations;chemical products for use in medical science;pharmaceutical and biochemical preparations for the treatment of cancer.」及び第10類「Instruments and apparatus for the administration of gene therapy and prophylaxis preparations and substances,pre−filled vials;syringes and injectors for medical purposes.」と限定されたものである。

2 原査定の拒絶の理由の要点

原査定において、「本願商標は、登録第5012638号商標(以下「引用商標」という。)と同一又は類似の商標であって、同一又は類似の役務について使用をするものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願の指定役務は、前記1のとおり限定された結果、引用商標の指定役務と同一又は類似の役務については、すべて削除されたと認められ、本願の指定役務は、引用商標の指定役務と類似しない役務になった。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
