本願商標の識別力

1 本願商標

本願商標は、「snom」の欧文字を書してなり、第9類、第35類及び第42類の国際登録において指定された商品及び役務を指定商品及び指定役務として、2004年(平成16年)4月6日を事後指定日とするものである。そして、指定商品及び指定役務については、原審における平成17年1月28日付け手続補正書により、第9類の商品について補正された結果、第9類「Electric wires and cables,optical fiber cables;wire clips and clips for electric cables;cables channels (electric);data processing equipment,computers and other computer hardware,especially for controlling the transmission of electricity and data as well as the transmission of speech via internet protocols;nautical,surveying,photographic,cinematographic,optical,weighing,measuring,life−saving and teaching apparatus and instruments;luminous or mechanical signals;apparatus for recording,transmission and reproduction of sound,images,speech and data;electric installations for the remote contorol of industral operations,apparatus and instruments for transmission,forwarding and distributing of electricity and data;telecommunication apparatus;parts of all the aforementioned goods;computor display units,calculators,keyboards,printers,scanners,CD−ROM drives and apparatus for digital speech recognition and conversion,modems,ISDN cards,routers,hard discs,computer memories,motherboards,chips and controllers;other optical,acoustic and electronic apparatus;parts of all the aforementioned goods;computer software,all kinds of data carriers.」、第35類「Business consulting,organization and business management consulting;consulting with regard to the use of computer hardware and software as well as all kinds of communication technology in companies;organization project planning and organizational project management for computer hard− and software as well as communication technology;providing data in an internet homepage.」及び第42類「Providing development,further development,cultivation and installation of software,especially for transmission of speech via internet protocols;technological project planning and development of computers,computer hardware and computer networks;technological project planning and development of internal and external,also global networks;research in the field of the computer system and communication technology;renting of computers and other computer hardware;licensing of software;providing software via internet and other communication networks;consulting with regard to the use of computer hardware and software as well as all kinds of communication technology in internal,external,and global networks;operation of a service−hotline for the users of computer hardware and software.」になったものである。

2 引用商標

原査定において、本願商標が商標法第4条第1項第11号に該当するとして、本願の拒絶の理由に引用した登録第3313978号商標(以下「引用商標」という。)は、「SNOAM」及び「スノーム」の文字を二段に書してなり、平成6年5月12日に登録出願され、第9類に属する商標登録原簿に記載の商品を指定商品として、同9年5月30日に設定登録され、現に有効に存続しているものである。

3 当審の判断

引用商標の商標権は、商標登録原簿の記載によれば、平成21年6月15日に、本願の出願人に譲渡移転の手続がされたことにより、本願商標の出願人と引用商標の商標権者が同一人になったことが認められる。

したがって、本願商標が商標法第4条第1項第11号に該当するとした拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
