引用商標との抵触判断

1 本願商標

本願商標は、「J K ROWLING」の文字を横書きしてなり、第9類、第16類、第25類及び第28類に属する国際登録において指定された商品を指定商品として、1999年12月22日にUnited Kingdomにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2000(平成12)年6月21日を国際登録の日とするものである。そして、指定商品については、2002(平成14)年7月29日付けの商品及び役務の限定通報により、第9類「Instructional and teaching apparatus and instruments;apparatus for the processing,recording,transmission or reproduction of sound,video or images;parts and fittings for all the aforesaid goods;arcade video game machines;consumer video games;computer programmes and software;computer programmes and data recorded in computer accessible form;signal−and data−storage media;magnetic wires,magnetic tapes,magnetic and optical discs and cards;magnetic tapes and magnetic and optical discs bearing sound or video recordings;video and sound recording carriers;fridge magnets.」、第16類「Printed matter,newspapers,periodical publications;books;photographs;stationery;instructional and teaching material(except apparatus);plastic material for packaging(not included in other classes);playing cards;posters;pens;bookmarks;calendars;wrapping paper;notepads;greeting cards.」、第25類「Clothing,headgear;T−shirts,sweat shirts,hats,caps,baseball caps,head bands;jumpers,sweaters.」及び第28類「Games,toys and playthings;gymnastic and sporting articles;electronic toys and electronic games;decorations for Christmas trees.」と限定されたものである。

2 原査定の拒絶理由の要点

原査定は、「本願商標は、登録第1007570号商標(以下「引用商標1」という。)、登録第1211957号商標(以下「引用商標2」という。)及び登録第1773642号商標(以下「引用商標3」という。)と同一又は類似であって、同一又は類似の商品について使用をするものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、その指定商品について前記1のとおり限定された結果、引用商標1及び3の指定商品と同一又は類似の商品は、すべて削除されたと認められるものである。

してみれば、本願商標の指定商品と引用商標1及び3の指定商品とは抵触しないものとなった。

さらに、引用商標2の商標権は、商標登録原簿の記載によれば、取消審判の請求があった結果、商標権を取り消すべき旨の審決が平成14年5月7日に確定し、商標権の抹消の登録が同年6月19日にされているものである。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願を拒絶すべき理由を発見しない。

よって、結論のとおり審決する。
