限定通報による拒絶理由解消

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第9類、第16類、第38類、第41類及び第42類の国際登録において指定された商品又は役務を指定商品又は指定役務として、2000年1月13日Germanyにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2000年(平成12)7月13日を国際登録の日とするものであり、その後、指定商品及び指定役務については、2003(平成15)年1月10日付の限定通報により、第9類「Electronic apparatus and instruments;optical apparatus and instruments,measuring apparatus and instruments,luminous or mechanical signals,television apparatus as teaching apparatus;television apparatus;automatic vending machines and mechanisms for coin operated apparatus;data processing equipment and computers.」、第16類「Printed matter,especially stamped and/or printed cards of cardboard or plastic;instructional and teaching material(except apparatus);office requisites(except furniture).」、第38類「Television broadcasting.」、第41類「Education;instruction;entertainment services;organization of sports competitions;organization of exhibitions for cultural or educational purposes;presentation of live performance;organization of shows(impresario services);arranging and conducting of seminars;lending libraries;publication and issuing of books,periodicals and further printed matter as well as corresponding electronic media(including CD−ROMs and CD−Is).」及び第42類「Computer programming;data base services,namely rental of access time to and operation of a data base;rental services relating to data processing equipment and computers;projecting and planning services relating to equipment for telecommunication.」と限定されたものである。

2 原査定の拒絶の理由の要点

原査定において、本願商標について商標法第4条第1項第16号及び同第6条第1項に該当する旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、その指定商品及び指定役務について前記のとおり「限定通報」により限定された結果、これを本願指定商品又は指定役務に使用しても、商品の品質又は役務の質について誤認するものとはいえず、また、本願指定商品又は指定役務の内容及び範囲が明確になったと認められるから、商標法第6条第1項の要件をも具備するものとなった。

したがって、本願商標が商標法第4条第1項第16号及び同法第6条第1項に該当するとの、原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
