CELL商標の識別力と類否

第1 本願商標

本願商標は、「CELL」の文字を標準文字で表してなり、第9類「マイクロプロセッサー,中央処理装置,パーソナルコンピュータ及びその部品・附属品,携帯情報端末,コンピュータソフトウェア,コンピュータプリンター,光ディスクドライブ,磁気ディスクドライブ,コンピュータ用マザーボード・ハードディスクドライブ・キーボード・モニター,その他の電子応用機械器具及びその部品,テレビジョン受信機,液晶テレビジョン受信機,プラズマディスプレイテレビジョン受信機,プロジェクションテレビジョン受信機,DVDプレーヤー,DVDレコーダー,CDプレーヤー,CDレコーダー,MDプレーヤー,MDレコーダー,ハードディスクプレーヤー,デジタルオーディオプレーヤー,テープレコーダー,ビデオテープレコーダー,ハードディスクレコーダー,ハードディスクビデオレコーダー,ビデオカメラ,デジタルカメラ,ヘッドホン,イヤホン,アンプリファイヤー,チューナー,スピーカー,車載用オーディオ/ビデオシステム及びその部品・附属品,その他の電気通信機械器具,家庭用テレビゲームおもちゃ及びその部品・附属品」及び第28類「携帯用液晶画面ゲームおもちゃ及びその部品・附属品」を指定商品として、平成17年1月24日に登録出願され、その後、指定商品については、当審における同19年4月2日付け提出の手続補正書により、第9類「メモリー内蔵のマイクロプロセッサー,メモリー内蔵の中央処理装置」に補正されたものである。

第2 原査定の拒絶の理由の要点

原査定は、以下の理由(1)ないし(3)のとおり認定、判断し、本願を拒絶したものである。

(1)本願商標は、「CELL」の欧文字を書してなるところ、この語は、「ビット記憶素子、記憶装置の最小単位であり、1ビットを記憶することができるもの」を意味するものであるから、本願商標をその指定商品中、例えば、上記に照応する半導体素子について使用するときは、これに接する取引者、需要者は、前記意味合いを把握、認識するに止まり、自他商品の識別標識としての機能を果たさないものと判断するのを相当とする。したがって、本願商標は、その指定商品中、前記に照応する商品ついて使用するときは、単に商品の品質を普通に用いられる方法で表してなるにすぎず、商標法第3条第1項第3号に該当し、上記に照応する商品以外の商品(例えば、半導体素子、電子回路)に使用するときは、商品の品質の誤認を生ずるおそれがあるので、同法第4条第1項第16号に該当する。

(2)本願商標は、以下の登録商標と同一又は類似であって、その商標に係る指定商品と同一又は類似の商品について使用するものであるから、商標法第4条第1項第11号に該当する。

(a)登録第2506565号商標(以下「引用商標1」という。)は、別掲1のとおりの構成よりなり、昭和60年1月31日登録出願、第11類に属する商標登録原簿に記載のとおりの商品を指定商品として、平成5年2月26日に設定登録、その後、同15年1月28日に商標権の存続期間の更新登録がされ、さらに、同15年3月19日に、第9類「電子応用機械器具及びその部品,電気通信機械器具」及び第11類「電球類及び照明用器具,家庭用電熱用品類」を指定商品とする書換登録がされたものである。

(b)登録第2506566号商標(以下「引用商標2」という。)は、別掲2のとおりの構成よりなり、昭和60年1月31日登録出願、第11類に属する商標登録原簿に記載のとおりの商品を指定商品として、平成5年2月26日に設定登録、その後、同15年1月28日に商標権の存続期間の更新登録がされ、さらに、同15年3月19日に、第9類「電子応用機械器具及びその部品,電気通信機械器具」及び第11類「電球類及び照明用器具,家庭用電熱用品類」を指定商品とする書換登録がされたものである。

(c)登録第4386428号商標(以下「引用商標3」という。)は、「セル」の文字を標準文字により表してなり、平成11年1月8日登録出願、第9類に属する商標登録原簿に記載のとおりの商品を指定商品として、平成12年5月26日に設定登録がされたものである。

(d)登録第4740939号商標(以下「引用商標4」という。)は、別掲3のとおりの構成よりなり、平成15年3月14日登録出願、第7類、第9類、第35類、第37類、第41類及び第42類に属する商標登録原簿に記載のとおりの商品及び役務を指定商品及び指定役務として、平成16年1月16日に設定登録されたものである。

(e)登録第4883738号商標(以下「引用商標5」という。)は、「CEL」の文字を標準文字により表してなり、平成16年10月29日登録出願、第9類に属する商標登録原簿に記載のとおりの商品を指定商品として、平成17年7月29日に設定登録されたものである。

(f)国際登録第797242号商標(以下「引用商標6」という。)は、別掲4のとおりの構成よりなり、平成14年(2002年)12月31日を国際登録の日とし、第5類「Diagnostic products, reagents for medical, veterinary or pharmaceutical purposes; pharmaceutical and veterinary products; disinfectants.」、第9類「Photographic, optical apparatus and instruments, particularly computer-assisted systems for cell separation, examination and transformation; light sources for use in laboratory, photographic and optical apparatus and instruments, particularly for cell separation, examination and processing; apparatus for recording, transmitting or reproducing sound and images; magnetic and optical data media for recording programs (software) as well as data, sounds and images; programs (software), including operating systems, particularly for use in the field of scientific medicine, as well as for archiving, exploitation and representation of measured values; computer hardware as well as data processing apparatus.」及び第10類「Medical and veterinary apparatus and instruments.」を指定商品として、同16年(2006年)3月12日に設定登録されたものである。

(g))国際登録第830484号商標(以下「引用商標7」という。)は、別掲5のとおりの構成よりなり、平成16年(2004年)4月15日を国際登録の日とし、第5類「Diagnostics and reagents for medical/veterinary or pharmaceutical purposes; pharmaceutical and veterinary products; disinfectants.」、第9類「Photographic and optical apparatus and instruments, in particular computer-supported systems for separation, examination and additional processing of cells; light generators for use in photographic and optical apparatus and instruments, in particular in view of the separation, examination and additional processing of cells; apparatus for recording, transmission or reproduction of images and sound; magnetic and optical data carriers for recording computer software, as well as data of images and sound, in particular DVDs, CDs and floppy disks; computer software, including operating systems, in particular for use in the medical science field, as well as for the storage, evaluation and presentation of measuring data; computer hardware, as well as data processing equipment.」及び第10類「Medical and veterinary apparatus and instruments.」を指定商品として、同17年(2005年)10月21日に設定登録されたものである。

(h)国際登録第838369号商標(以下「引用商標8」という。)は、別掲6のとおりの構成よりなり、平成16年(2004年)9月29日を国際登録の日とし、第5類「Diagnostic preparations, reagents for medical/veterinary or pharmaceutical purposes; pharmaceutical and veterinary products; disinfectants.」、第9類「Photographic and optical apparatus and instruments, in particular for computer based systems for the separation, examination and additional processing of cells; light generators for the use in photographic and optical apparatus and instruments, in particular in view of the separation, examination and additional processing of cells; apparatus for recording, transmission or reproduction of images and sound; magnetic and optical data carriers for recording computer software, as well as data of images and sound, in particular DVDs, CDs and floppy disks; computer software, including operating systems, in particular for use in the medical science field, as well as for the storage, evaluation and presentation of measuring data; computer hardware, as well as data processing equipment.」及び第10類に属する国際登録簿に記載の商品を指定商品として、同18年(2006年)6月23日に設定登録されたものである。

(i)国際登録第838370号商標(以下「引用商標9」という。)は、別掲7のとおりの構成よりなり、平成16年(2004年)9月29日を国際登録の日とし、第5類「Diagnostic preparations, reagents for medical/veterinary or pharmaceutical purposes; pharmaceutical and veterinary products; disinfectants.」、第9類「Photographic and optical apparatus and instruments, in particular for computer based systems for the separation, examination and additional processing of cells; light generators for the use in photographic and optical apparatus and instruments, in particular in view of the separation, examination and additional processing of cells; apparatus for recording, transmission or reproduction of images and sound; magnetic and optical data carriers for recording computer software, as well as data of images and sound, in particular DVDs, CDs and floppy disks; computer software, including operating systems, in particular for use in the medical science field, as well as for the storage, evaluation and presentation of measuring data; computer hardware, as well as data processing equipment.」及び第10類「Medical and veterinary apparatus and instruments.」を指定商品として、同18年(2006年)6月23日に設定登録されたものである。

(j)国際登録第838371号商標(以下「引用商標10」という。)は、別掲8のとおりの構成よりなり、平成16年(2004年)9月29日を国際登録の日とし、第9類「Photographic and optical apparatus and instruments, in particular for computer based systems for the separation, examination and additional processing of cells; light generators for the use in photographic and optical apparatus and instruments, in particular in view of the separation, examination and additional processing of cells; apparatus for recording, transmission or reproduction of images and sound; magnetic and optical data carriers for recording computer software, as well as data of images and sound, in particular DVDs, CDs and floppy disks; computer software, including operating systems, in particular for use in the medical science field, as well as for the storage, evaluation and presentation of measuring data; computer hardware, as well as data processing equipment.」及び第10類「Medical and veterinary apparatus and instruments.」を指定商品として、同18年(2006年)6月23日に設定登録されたものである。

(k)国際登録第841463号商標(以下「引用商標11」という。)は、別掲9のとおりの構成よりなり、平成16年(2004年)9月29日を国際登録の日とし、第5類「Diagnostic preparations, reagents for medical/veterinary or pharmaceutical purposes; pharmaceutical and veterinary products; disinfectants.」、第9類「Photographic and optical apparatus and instruments, in particular for computer based systems for the separation, examination and additional processing of cells; light generators for the use in photographic and optical apparatus and instruments, in particular in view of the separation, examination and additional processing of cells; apparatus for recording, transmission or reproduction of images and sound; magnetic and optical data carriers for recording computer software, as well as data of images and sound, in particular DVDs, CDs and floppy disks; computer software, including operating systems, in particular for use in the medical science field, as well as for the storage, evaluation and presentation of measuring data; computer hardware, as well as data processing equipment.」及び第10類「Medical and veterinary apparatus and instruments.」を指定商品として、同18年(2006年)8月4日に設定登録されたものである。

(3)本願の指定商品中、第9類「コンピュータプリンター,車載用オーディオ/ビデオシステム及びその部品・附属品」は、その内容及び範囲を明確に指定したものとは認められないから、本願は、商標法第6条第1項及び第2項の要件を具備しない。

第3 当審の判断

(1)商標法第3条第1項第3号及び同法第4条第1項第16号について

本願商標は、その指定商品について前記第1のとおり補正された結果、これをその指定商品に使用しても、特定の商品の品質を直接かつ具体的に表示したものとはいえず、また、商品の品質の誤認を生ずるおそれもないものである。

したがって、本願商標が商標法第3条第1項第3号及び同法第4条第1項第16号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

(2)商標法第6条第1項及び第2項について

本願商標は、その指定商品について前記第1のとおり補正された結果、商品の内容及び範囲が明確となり、かつ、政令で定める商品の区分に従ったものになり、商標法第6条第1項及び第2項の要件を具備するものとなった。 したがって、本願が商標法第6条第1項及び第2項に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

(3)商標法第4条第1項第11号について

(a)本願商標と引用商標3との類否について

本願商標は、その指定商品について前記第1のとおり補正された結果、引用商標3の指定商品と同一又は類似の商品は、すべて削除されたと認められるものである。

その結果、本願商標の指定商品は、引用商標3の指定商品と類似しない商品になったと認められるものである。

(b)本願商標と引用商標1、2、4、5との類否について

本願商標は、前記第1のとおり「CELL」の文字よりなるところ、これよりは「セル」の称呼及び「電池、記憶素子」の観念が生ずるものである。 引用商標1は、別掲1のとおりの構成よりなるところ、その構成文字に相応して「エスイーエル」「ハンドウタイエネルギーケンキュージョ」の称呼を生ずるというのが相当である。

引用商標2は、別掲2のとおりの構成よりなるところ、その構成文字に相応して「エスイーエル」「セミコンダクターエナージーラボラトリー」の称呼を生ずるというのが相当である。

引用商標4は、別掲3のとおりの構成よりなるところ、その構成文字に相応して「エスイーエル」の称呼を生ずるというのが相当である。

引用商標5は、「CEL」の文字よりなるところ、その構成文字に相応して「シーイーエル」の称呼を生ずるというのが相当である。

そうとすれば、引用商標1、2、4、5より「セル」の称呼をも生ずるとし、そのうえで、本願商標と引用商標1、2、4、5が称呼上類似するとした原査定の認定、判断は、妥当なものということはできない。

また、本願商標と引用商標1、2、4、5とは、それぞれの構成よりみて外観上、明らかに区別し得る差異を有するものであり、さらに、観念においては、引用商標1、2、4、5は特定の観念を生ずるものとは認められないから、本願とは比較することができないものである。

してみれば、本願商標と引用商標1、2、4、5とは、称呼、外観及び観念のいずれの点においても、相紛れるおそれのない非類似の商標といわざるを得ない。

(c)本願商標と引用商標6ないし11との類否について

引用商標6ないし11は、別掲4ないし9のとおりの構成よりなるところ、いずれも構成中に「cell」の文字を有するものであり、「cell」の文字とその右側上部の図案化された文字、記号は異なる大きさ、書体で表されていることから、全体が常に一体のものとして把握されるとはいい難いく、「cell」の文字部分は独立して自他商品の識別標識として機能し得るというべきであるから、その構成文字に相応して「セル」の称呼及び「電池、記憶素子」の観念が生ずるというのが相当である。

してみれば、本願商標と引用商標6ないし11とは、外観において差異が認められるとしても、それぞれより生ずる「セル」の称呼及び「電池、記憶素子」の観念を共通にする類似の商標であり、また、本願商標の補正後の指定商品は、引用商標6ないし11の指定商品と同ー又は類似のものである。

(4)むすび

したがって、本願商標が商標法第4条第1項第11号に該当するとして本願を拒絶した原査定は妥当であって、取り消すことはできない。

よって、結論のとおり審決する。
