ByDesignの識別力

1 本願商標

本願商標は「ByDesign」の欧文字を書してなり、第9類、第16類、第35類、第38類、第41類及び第42類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び役務として、2007年6月25日にGermanyにおいてした商標登録に基づいて、パリ条約第4条による優先権を主張し、同年(平成19年)9月21日に国際商標登録出願されたものである。

その後、第38類及び第42類に属する指定役務については、原審における平成20年9月11日付け手続補正書により、当該補正書に記載のとおりの指定商品に補正された結果、第9類「Machine−readable data media(recorded);computer programs and software;magnetic data carriers,namely magnetic tapes,magnetic disks,magnetic wafers and magnetic cards.」、第16類「Printed accompanying material for software and data processing programs,namely manuals,catalogs,user guides and operating instructions.」、第35類「Systematization of data and information in computer data bases accessible on the Internet,including data and information relating to the development,creation,programming,production,performance,distribution,application,use,mode of operation,handling,modification,maintenance,rental,updating,design and outsourcing of computer programs and software.」、第38類「Internet services,namely providing access to data and information on the Internet,including data and information relating to the development,creation,programming,production,performance,distribution,application,use,mode of operation,handling,modification,maintenance,rental,updating,design and outsourcing of computer programs and software;providing interactive communications services online or on the Internet,namely,communications by computer terminals.」、第41類「Training on use and application of data processing programs.」、第42類「Creation,development and design of computer programs and software,particularly for use in areas such as financial and control management,production and materials management,quality management and plant maintenance,distribution,human resources and project management and also for general office functions such as word processing,electronic mail and archiving;implementation,servicing,rental,updating and maintenance of computer programs and software,for others;technical consultancy and advice regarding programming,design,development,use and application of computer programs and software;research in the field of computer programs and software.」となったものである。

2 引用商標

原査定おいて、本願の拒絶の理由に引用した登録第4752717号商標(以下、「引用商標」という。)は別掲のとおりの構成よりなり、第9類「テレビジョン受信機」を指定商品として平成15年8月13日に登録出願され、平成16年3月5日に設定登録されたものである。

3 当審の判断

引用商標の商標権は、商標登録原簿の記載によれば、請求人(出願人)が譲渡により取得し、その移転の申請が平成21年9月14日になされ、本願商標の請求人(出願人)と引用商標の商標権者とは同一人になった。

したがって、本願商標が商標法第4条第1項第11号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
