欧文字商標の称呼類似

1 本願商標

本願商標は、「CILAS Ecosizer」の欧文字を書してなり、2006年10月9日にFranceにおいてした商標登録出願に基づいて、パリ条約第4条による優先権を主張し、2007(平成19年)年3月26日に国際商標登録出願、第9類「Apparatus for laser particle analysis;apparatus for analysis of dimensions of particles by laser;laser granulometers;software for laser particle analysis.」、第41類「Arranging and conducting of colloquiums,conferences,conventions and seminars,symposiums regarding laser particle analysis;publication of books and reviews concerning laser particle analysis.」及び第42類「Technical research for laser particle analysis;engineering concerning design of apparatus for laser particle analysis;design of apparatus for laser particle analysis;professional consultancy concerning design of apparatus for laser particle analysis;development(design),installation,updating and maintenance of software for laser particle analysis;computer programming for laser particle analysis;provision of computer software in connection with laser particle analysis.」を指定商品及び指定役務として、2008(平成20年)年12月12日に設定登録されたものである。

2 引用商標

原査定において、本願の拒絶の理由に引用した国際登録第863902号商標(以下「引用商標」という。)は、「SIRILAS」の欧文字を書してなり、2004年8月16日にGermanyにおいてした商標登録出願に基づいて、パリ条約第4条による優先権を主張して2004年(平成16年)11月27日に国際商標登録出願、第9類「Apparatus and instruments for conducting,switching,transforming,accumlating,regulating or controlling electricity;light control installations;light emitting diodes,also organic light emitting diodes;laser diodes,especially power laser diodes,semi−conductor power laser diodes for material processing,semi−conductors devices;light conductors,optoelectronic couplers,optical sensors,light barriers;light emitting diode lamp modules(namely,modules with lamp functions designed from light emitting diodes,also organic light emitting diodes),especially for lighting and signalling purposes;displays in light emitting diode technology(also displays in organic light emitting diode technology);electronic ballasts for lighting purposes,switches for lighting apparatus;electronic starters for lamps and luminaires;parts of the aforesaid goods included in this class.」及び第11類「Lighting apparatus,especially electric lamps and luminaires;parts of the aforementioned goods.」を指定商品として、平成18年11月17日に設定登録され、現に有効に存続しているものである。

3 登録異議の申立ての理由(要旨)

本件商標は、大文字の「CILAS」を小文字混じりの「Ecosizer」と間隙を空けて左横書きしてなるから、顕著に表された「CILAS」より「シーラス」又は「シラス」の称呼を生ずる。

これに対し、引用商標は、大文字で書した「SIRILAS」に照応した「シリラス」の称呼を生ずるので、両商標は相紛らわしい称呼上類似の商標である。

また、本件商標と引用商標とは、「I」「L」「A」「S」の4文字が共通する外観上も類似の商標である。

そして、両商標はそれぞれの指定商品が互いに類似する。

したがって、本件商標は、商標法第4条第1項第11号に該当するから、同法第43条の2第1号により、その登録は取り消されるべきである。

4 当審の判断

本件商標は、「CILAS Ecosizer」の文字よりなるところ、これを構成する「CILAS」及び「Ecosizer」の文字は特定の意味を有しないものである。そして、本件商標は、その両文字間の態様に軽重の差はなく、全体として外観上まとまりよく構成されており、これらを分離して見なければならない特段の事情も見あたらないものであって、その構成文字に相応して生ずる「シーラスエコサイザー」の称呼もよどみなく一連に称呼し得るものである。

また、その構成中の「Ecosizer」文字部分を省略して、「CILAS」の文字部分のみに着目して取引にあたらなければならない格別の事由も見出せないことから、本件商標に接する取引者、需要者は、その構成全体をもって一体不可分のものと認識、把握し、本件商標の構成文字全体に相応して「シーラスエコサイザー」の称呼をもって取引に当たるというのが自然である。

そうすると、本件商標より「シーラスエコサイザー」の称呼のみを生じるといわなければならない。

してみれば、本件商標中の「CILAS」の文字に着目し、かつ、本件商標より「シーラス」の称呼をも生ずるとし、その上で本件商標と引用商標は称呼において類似するとする本件登録異議の申立ての理由は妥当でなく、この理由をもって両商標を類似のものとすることはできない。

他に、両商標を類似のものとすべき理由は見出せない。

したがって、本件商標は、商標法第4条第1項第11号に違反して登録されたものではないから、同法第43条の3第4項の規定に基づき、その登録を維持すべきものである。

よって、結論のとおり決定する。
