指定商品役務の類似性

1 本願商標

本願商標は、「CULTEX」の欧文字を書してなり、第9類、第42類及び第44類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2006年9月13日にGermanyにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2007年(平成19年)3月13日に国際商標登録出願されたものである。

その後、指定商品及び指定役務については、原審における平成20年8月15日付けの手続補正書及び当審における2009年(平成21年)9月30日付けで国際登録簿に記録された限定の通報があった結果、第9類「Scientific instruments and equipment for medical or biological research in the laboratory,for analytical purposes and for toxicity investigations;optical equipment,particularly microscopes,weighing equipment;microporous membranes used for incubators for bacteria culture;probes for scientific purposes.」、第42類「Basic research in the fields of medicine,biology or chemistry;development of equipment for research in the fields of medicine,biology or chemistry;planning and design of equipment for the cultivation and exposure of cells or bacteria by using 3D−CAD techniques to ensure full feasibility and implementability in conjunction with optimized functional aspects prior to production of medicine and chemicals;industrial analysis and research services;design and development of computer hardware and software;provision of technical expert opinions in the fields of medicine,molecular biology,biology,biochemistry or chemistry;execution of scientific tests;chemical laboratory services;scientific research for medical purposes.」及び第44類「Medical analysis services relating to the treatment of persons.」とされた。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、登録第2522359号商標(以下『引用商標』という。)と同一又は類似の商標であって同一又は類似の商品について使用をするものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願の指定商品及び指定役務は、前記1のとおり商品が限定された結果、引用商標の指定商品と同一又は類似の商品はすべて削除され、本願の指定商品は、引用商標の指定商品と類似しない商品になったものと認められる。

したがって、本願商標が、商標法第4条第1項第11号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
