指定商品の類似性

1 本願商標

本願商標は、「MAYA」の欧文字を標準文字で表してなり、第25類に属する願書に記載のとおりの商品を指定商品として、平成21年12月14日に登録出願、その後、指定商品については、当審における平成23年4月13日付けの手続補正書により、第25類「洋服,コート,セーター類,ワイシャツ類,寝巻き類,下着,水泳着,水泳帽,和服,履物」と補正されたものである。

2 引用商標

原査定において、本願商標が商標法第4条第1項第11号に該当するものとして引用した国際登録第1006015号商標(以下「引用商標」という。)は、別掲に示すとおりの構成よりなり、2008年9月29日にイタリア国においてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、平成21年3月5日に国際商標登録出願、第3類「Cleaning, polishing, scouring and abrasive preparations; soaps; perfumery, essential oils, cosmetics, hair lotions; dentifrices.」、第9類「Apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity; apparatus for recording, transmission or reproduction of sound or images; apparatus for transmitting and reproducing sound or images, audio cassette recorders, audio tape recorders, DVD-players, video cameras, cellular telephones, cell phone covers, cordless telephone apparatuses, cases for mobile phones, eyeglasses and sunglasses, cases for spectacles, eye glass chains, eye glass leashes, eyeglass frames, walkie-talkies.」、第14類「Horological and chronometric instruments, namely watches, clocks, table clocks, stopwatches, chronometers, alarm watches, digital watches, analogue watches.」、第16類「Plastic materials for packaging (not included in other classes).」及び第25類「Garter belts, foulards, gloves, shawls, scarves, neckties, bow ties, belts(clothing), suspenders, hats and caps; all the above goods made with/of fox fur.」を指定商品として、同23年5月13日に設定登録されたものである。

3 当審の判断

本願の指定商品は、前記1のとおり補正された結果、引用商標に係る指定商品と同一又は類似の商品はすべて削除され、引用商標に係る指定商品とは類似しない商品になった。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は解消した。

よって、結論のとおり審決する。
