拒絶理由不明

1 本願商標

本願商標は、別掲のとおりの構成からなり、第6類、第16類、第20類、第23類、第24類、第26類及び第28類に属する日本国を指定する国際登録において指定された商品を指定商品として、2011年(平成23年)12月13日に国際商標登録出願され、その後、指定商品については、原審における平成25年9月20日付け手続補正書、当審における2015年(平成27年)8月31日及び2016年(平成28年)2月23日付けで国際登録簿に記録された限定の通報があった結果、第16類「Stationery;adhesive tapes for stationery or household purposes,stamps (seals),inking pads,stamp inks;books and magazines in the field of hobbies and crafts;cardboard;containers of cardboard for packaging,boxes of paper and stationery,pictures,bookbinding cloth,fabrics for bookbinding,etching needles,engraving plates,engravings,gummed tape (stationery),announcement cards,art pictures,art prints,autograph books,bookmarks,cards bearing universal greetings,children’s activity books,Christmas cards,colored printed matter,coloring books,cook books,correspondence cards,daily planners,date books,diaries,engagement books,fountain pens,gift cards,gift wrap paper,greeting cards,invitation cards,memorandum books,musical greeting cards,note books,note cards,paperweights,pencils,pens,personal organizers,photograph albums,picture books,picture postcards,pocket calendars,postcards,posters,printed invitations,prints,scrapbook albums,scrapbooks,sketch books,social note cards,song books,stationery writing paper and envelopes,stickers,trading cards,travel guide books,wall calendars;stickers,bumper stickers,stationery stickers;stamps (seals),inking pads,stamp inks;decorative glitter paper and stickers;paint brushes.」及び第24類「Cotton fabrics,woollen fabric,jute fabric,flannel (fabric),frieze (cloth),textiles of synthetic materials and glass cloth,woven and non−woven textile fabrics,elastic woven material,velvet,crepe (fabric),felt,table linen (not of paper),tablecloths,bath linen,towels of textile,table napkins of textile,handkerchiefs,bed clothes,bed sheets,sheets,bed covers of paper,travelling rugs,diapered linen,household linen,wall hangings of textile,linings,labels (cloth),silk cloth,velvet;knitted fabric.」とされたものである。

2 原査定の拒絶の理由の要点

原査定は、以下のとおり、認定、判断し、本願を拒絶したものである。

(1)本願は、第20類及び第26類において、商品の内容及び範囲を明確に指定したものとは認められない指定商品を包含していることから、商標法第6条第1項の要件を具備しない。

(2)本願商標は、第16類及び第26類において、広範な範囲にわたる商品を指定しているので、商標の使用又は使用の意思があることについての疑義があることから、商標法第3条第1項柱書の要件を具備しない。

(3)本願商標は、登録第5124576号商標(以下「引用商標」という。)と同一又は類似の商標であって、同一又は類似の商品について使用をするものであるから、商標法第4条第1項第11号に該当する。

3 当審の判断

本願の指定商品は、前記1のとおり補正及び限定されたものである。

その結果、本願の指定商品は、その内容及び範囲が明確になったと認められることから、本願は、商標法第6条第1項の要件を具備するものとなった。

そして、商標の使用又は使用の意思があることについて疑義がなくなったものと認められることから、本願商標は、商標法第3条第1項柱書の要件を具備するものとなった。

また、本願の指定商品は、引用商標の指定商品と類似の商品がすべて削除され、引用商標の指定商品と類似しない商品になったことから、本願商標は、商標法第4条第1項第11号に該当しない。

したがって、原査定の拒絶の理由は解消した。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
