国際登録商標の範囲確定

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第7類、第9類及び第37類に属する商品及び役務を指定商品及び指定役務として、2001年(平成13年)4月6日に国際登録されたものである。

そして、指定商品及び指定役務については、平成14年6月26日付け手続補正書、及び2004年5月6日国際登録簿に関する更正の通報があった結果、最終的に、第7類「Tools for machining railway wheels,wheel sets,running gear for rail vehicles or parts thereof,and for crankshafts or control shafts,flywheels,gearwheels or gear rims of piston engines as well as for motor vehicle wheels or parts thereof,in particular tools for turning,milling,drilling,broaching,grinding,honing or lapping or combinations thereof,as well as tools for planishing rolling,fixed rolling and straightening rolling and combinations thereof,and tools for machining using laser rays;and machine tools,in particular machine tools for machining railway wheels,wheel sets,running gear for rail vehicles or parts thereof,and for crankshafts or control shafts,flywheels,gearwheels or rims of piston engines as well as for motor vehicle wheels or parts thereof;in particular machines for turning,milling,broaching and combinations of these machines,grinding machines and finish−grinding machines such as honing machines and lapping machines;machines for planishing rolling,fixed rolling,straightening rolling and combinations of such machines,as well as machine tools for machining with laser rays;metalworking machines and tools;equipment for generating and controlling hydraulic or pneumatic pressure means,in particular pumps,valves,pressure lines;machinery and equipment for cleaning,washing,preserving and coating wheels for motor vehicles or parts thereof,or for crankshafts or control shafts,flywheels,gearwheels or gear rims of piston engines,in particular washing machines,spraying equipment,immersion baths,powder−coating equipment,dryers,using water,cleaning fluids,preservation solutions,surface coating materials,either with or without pressure.」、及び、第9類「Measuring and testing apparatus for measuring and testing surfaces,shapes and the internal condition of railway wheels,wheel sets,running gear for rail vehicles or parts thereof and of crankshafts or control shafts,flywheels,gearwheels or gear rims of piston engines as well as of motor vehicle wheels or parts thereof,in particular machinery and equipment with devices for transmitting and receiving light rays,laser rays,X−rays,ultrasound,magnetic fields,for fluorescence analysis,for mechanical scanning;equipment and devices for detection/recognition,testing and measuring wheels,brake disks,brake shoes,wheel sets,running gear,bodies and superstructures,current collectors for rail vehicles,for wheels of motor vehicles or parts thereof,either while stationary or while moving,for crankshafts or control shafts,flywheels,gearwheels or gear rims of piston engines or parts thereof(included in this class).」を指定商品とするものである。

2 原査定の理由

原審において、「本願商標は、登録第2205938号,登録第2484273号及び登録第4349786号の各商標登録(以下、併せて「引用各商標」という。)と同一又は類似であって、その商標に係る指定商品と同一又は類似の商品について使用するものであるから、商標法第4条第1項第11号に該当する」旨及び、「上記補正書により補正された指定商品においては、内容等が不明確なものを含む」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標の指定商品について、前記1のとおり手続補正書の提出及び国際登録の更正の通報があった結果、引用各商標の指定商品と同一又は類似の商品は全て削除され、互いに抵触しないものとなった。

また、前記更正の通報及び表示の補正によって、本願商標の指定商品は、商標法第6条第1項の規定の要件を具備するものとなった。

したがって、本願商標が商標法第4条第1項第11号に該当し、また、本願商標が商標法第6条に規定の要件を具備しない、とする原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
