1 本件商標
本件国際登録第763345号商標(以下「本件商標」という。)は、別掲(1)に示すとおり、黒塗りの横長長方形内に「AVON essential」の欧文字(ただし、「N」の後の「e」の文字の上下には小さな横線が施されている。)を横書きしてなり、2001年1月18日にFrance国においてした出願に基づきパリ条約第4条による優先権を主張して2001(平成13)年7月18日を国際登録の日とし、第3類「Cleaning,polishing,scouring and abrasive preparations;perfumery,sanitary and beauty products,namely make−up,cosmetic lotions and cosmetic creams,brilliantines,shampoos,dentifrices,hair tints,toilet soaps;soaps,deodorant soaps,eaux de toilette,scented water,essential oils,oils for toilet purposes,almond oils and milk of almonds for cosmetic use,cleansing milk,colorants for toilet purposes,antiperspirants,cosmetics,lipstick,cotton wool for cosmetic purposes,make−up powder,cosmetic products for skin care,cosmetic bath preparations,cotton buds for cosmetic purposes,cosmetic creams,cosmetic pencils,make−up removing preparations,paper guides for eye make−up,nail varnish for cosmetic purposes,pomades for cosmetic purposes,cosmetic suntan preparations,shampoos,hair lotions,cosmetic dyes,shaving products,after−shave lotions,non−medicated mouth care products,talcum powder,depilatories,hair lotions,cream baths for hair care,oil baths for hair care,smoothing stones,rubbing stones,pumice stones,powder and rouge tablets,lipsticks,rouges,powders,tonics,creams and cosmetic lotions for the face,skin and hands,creams and styptic pencils for cosmetic use,bath salts and essences for non−medical use;deodorant for personal use and mouth washes,not for medical purposes;creams and astringent hamamelis extracts for non−medical use,preparations for rinsing the hair,hair oils and lotions,hair tonic preparations,lotions for beards,shampoo preparations,hair care preparations,cosmetic bay rum preparation for hair care,nail varnish and nail cream,cosmetic preparation for removing or applying nail varnish,cosmetic oils for the epidermis,cosmetic creams and cosmetic softening preparation,tooth cleanig preparations.」を指定商品として、平成15年2月21日に設定登録されたものである。
2 登録異議の申立の理由
登録異議申立人(以下「申立人」という。)は、以下の(1)ないし(3)の登録商標(以下、まとめて「引用商標」という。)を引用し、「本件商標は、引用商標と『エッセンシャル』の称呼において類似する商標であり、かつ、我が国において商品『シャンプー,リンス,トリートメント』等について長年に亘り使用され、取引者、需要者の間において広く知られている申立人の商標『エッセンシャル』又は『Essential』と同一の称呼を生ずる『essential』の文字を含んでなるから、商標権者が本件商標をその指定商品に使用するときには、商品の出所について混同を生ずるおそれがある。したがって、本件商標は、商標法第4条第1項第11号又は同第15号に該当し、その登録は取り消されるべきものである。」と主張し、証拠方法として甲第1号証ないし甲第35号証(枝番号を含む。)を提出している。
(1)登録第2117987号商標は、昭和60年7月16日に登録出願、別掲(2)に示すとおり、三日月のキャラクター風の図形下に「エッセンシャル」の片仮名文字を横書きしてなり、第4類「せっけん類(薬剤に属するものを除く)歯みがき、化粧品(薬剤に属するものを除く)香料類」を指定商品として、平成1年2月21日に設定登録、その後、同11年1月26日に商標権存続期間の更新登録がされたものである。
(2)同じく、登録第4168259号商標は、平成9年2月10日に登録出願、別掲(3)に示すとおり、やや図案化した「Essential」の欧文字を横書きしてなり、第3類「シャンプー,リンス,トリートメント」を指定商品として、平成10年7月17日に設定登録されたものである。
(3)同じく、登録第4530759号商標は、平成9年3月5日に登録出願、「エッセンシャル」の片仮名文字を横書きしてなり、第3類「シャンプー,リンス,トリートメント」を指定商品として、平成13年12月21日に設定登録されたものである。
3 当審における取消理由の要点
(1)申立人の主張の全趣旨及び提出に係る甲第8号証ないし甲第12号証(広告取扱証明書)、甲第13号証(ベンチマーク調査結果数表)、甲第14号証(「エッセンシャル」テレビ宣伝投入量、雑誌出稿実績表)、甲第15号証ないし甲第30号証(テレビ宣伝CF例)、甲第31号証ないし甲第35号証(雑誌広告例)、その他の甲各号証を総合すれば、申立人は、引用商標「エッセンシャル」又は「Essential」を「シャンプー、リンス、トリートメント」について、本件商標の国際登録(2001[平成13]年7月18日)前より長年に亘り(1976年以降2002年までの間)継続使用した結果、少なくとも、「エッセンシャル」といえば、申立人の取り扱いに係る「シャンプー、リンス、トリートメント」の商標として、「せっけん類、化粧品」の取引者、需要者の間において広く認識され、親しまれていた事実が認められる。
そして、当該周知性は、本件商標の登録査定時(2003[平成15]年1月23日)まで継続していたものと充分に推認し得るものである。
上記事実を踏まえて、本件商標と引用商標との混同可能性について検討するに、本件商標は、別掲(1)に示すとおり、ありふれた黒塗りの横長長方形内に「AVON essential」の欧文字を横書きしてなるものである。
ただし、本件商標の構成中、「N」の後の「e」の文字の上下に施された小さな横線は、本件商標の識別性に影響を及ぼすとみるべき格別の根拠は窺えず、むしろ、単なる付記と解すのが相当である。
しかして、本件商標の構成中、前半の「AVON」の欧文字が大文字で書してなるのに対し、同後半の「essential」の欧文字は、小文字で書してなるだけでなく、「AVON」との間のスペースもあり、書体も相違しており、容易に分離して認識できるものである。
また、本件商標は、一連で一つのまとまった観念を生ずるものではなく、何ら繋がりを有しないものである。
そうとすれば、本件商標に接する取引者、需要者は、全体構成とは別に、当該構成中、後半における「essential」の欧文字部分も独立して自他商品識別標識としての機能を果たす主要部とみて着目し、これより生ずる「エッセンシャル」の称呼のみをもって取引に資する場合も充分にあるというのが相当である。
してみると、本件商標よりは、「essential」の文字に相応し「エッセンシャル」の称呼を生じ、引用商標よりは、「Essential」又は「エッセンシャル」の文字に相応し「エッセンシャル」の称呼を生ずるものである。
そうすると、本件商標と引用商標とは、「エッセンシャル」の称呼を共通にする場合のある類似の商標というのが相当である。
また、引用商標の指定商品中「せっけん類、化粧品」に属する商品を本件商標の指定商品が多数含んでいることは明らかである。
(2)以上の点を総合勘案すると、商標権者が本件商標をその指定商品中の「perfumery,sanitary and beauty products,namely make−up,cosmetic lotions and cosmetic creams,brilliantines,shampoos,hair tints,toilet soaps;soaps,deodorant soaps,eaux de toilette,scented water,oils for toilet purposes,almond oils and milk of almonds for cosmetic use,cleansing milk,colorants for toilet purposes,antiperspirants,cosmetics,lipstick,make−up powder,cosmetic products for skin care,cosmetic bath preparations,cosmetic creams,cosmetic pencils,make−up removing preparations,paper guides for eye make−up,nail varnish for cosmetic purposes,pomades for cosmetic purposes,cosmetic suntan preparations,shampoos,hair lotions,cosmetic dyes,shaving products,after−shave lotions,non−medicated mouth care products,talcum powder,depilatories,hair lotions,cream baths for hair care,oil baths for hair care,powder and rouge tablets,lipsticks,rouges,powders,tonics,creams and cosmetic lotions for the face,skin and hands,creams and styptic pencils for cosmetic use,bath salts and essences for non−medical use;deodorant for personal use;creams and astringent hamamelis extracts for non−medical use,preparations for rinsing the hair,hair oils and lotions,hair tonic preparations,lotions for beards,shampoo preparations,hair care preparations,cosmetic bay rum preparation for hair care,nail varnish and nail cream,cosmetic preparation for removing or applying nail varnish,cosmetic oils for the epidermis,cosmetic creams and cosmetic softening preparation.」について使用するときには、他人の業務に係る商品と混同を生ずるおそれがあるものというべきであるから、商標法第4条第1項第15号の規定に該当し、当該商品の登録は取り消されるべきである。
3 当審の判断
商標権者に対し、平成15年10月22日付けで上記3の取消理由を通知し、期間を指定して意見書を提出する機会を与えたが、商標権者は何ら意見を述べるところがない。
そして、本件商標については、上記取消理由があるものと認められるから、本件商標の指定商品中「perfumery,sanitary and beauty products,namely make−up,cosmetic lotions and cosmetic creams,brilliantines,shampoos,hair tints,toilet soaps;soaps,deodorant soaps,eaux de toilette,scented water,oils for toilet purposes,almond oils and milk of almonds for cosmetic use,cleansing milk,colorants for toilet purposes,antiperspirants,cosmetics,lipstick,make−up powder,cosmetic products for skin care,cosmetic bath preparations,cosmetic creams,cosmetic pencils,make−up removing preparations,paper guides for eye make−up,nail varnish for cosmetic purposes,pomades for cosmetic purposes,cosmetic suntan preparations,shampoos,hair lotions,cosmetic dyes,shaving products,after−shave lotions,non−medicated mouth care products,talcum powder,depilatories,hair lotions,cream baths for hair care,oil baths for hair care,powder and rouge tablets,lipsticks,rouges,powders,tonics,creams and cosmetic lotions for the face,skin and hands,creams and styptic pencils for cosmetic use,bath salts and essences for non−medical use;deodorant for personal use;creams and astringent hamamelis extracts for non−medical use,preparations for rinsing the hair,hair oils and lotions,hair tonic preparations,lotions for beards,shampoo preparations,hair care preparations,cosmetic bay rum preparation for hair care,nail varnish and nail cream,cosmetic preparation for removing or applying nail varnish,cosmetic oils for the epidermis,cosmetic creams and cosmetic softening preparation.」については、商標法第43条の3第2項の規定により、その登録を取り消すべきものである。
一方、本件登録異議の申立に係るその余の指定商品第3類「Cleaning,polishing,scouring and abrasive preparations;dentifrices;essential oils;cotton wool for cosmetic purposes,cotton buds for cosmetic purposes;smoothing stones,rubbing stones,pumice stones;mouth washes,not for medical purposes;tooth cleaning preparations.」については、引用商標の指定商品と同一又は類似の商品とは認められないものであり、かつ、本件商標をそれに使用しても商品の出所について混同を生じさせるおそれはないから、同法第43条の3第4項の規定により、その登録を維持すべきである。
よって、結論のとおり決定する。
