OPENFOAMの識別力

1 本願商標

本願商標は、「OPENFOAM」の文字を横書きしてなり、第9類、第41類及び第42類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2007年(平成19年)8月10日に国際商標登録出願(事後指定)されたものである。

その後、指定商品及び指定役務については、当審における2009年(平成21年)7月23日付けで国際登録簿に記録された限定の通報があった結果、第41類「Education services;training services;educational and training consultancy services relating to computing and fluid dynamics;online tutorials in the field of computers,computer software,computer systems,business,business management and accounting;education and training services,namely,conducting classes and seminars in the field of computers,computer software,computer systems,business management and accounting;education in the field of data processing;education services for imparting data processing teaching methods;education services relating to data processing;education services relating to the maintenance of electronic data processing installations;education services relating to the repair of electronic data processing installations;educational services relating to data processing;instructional services relating to data processing;provision of instruction relating to data processing;services for data processing instruction;services for setting up data processing teaching programs;training in data processing techniques;training in the use of data processing apparatus;training in the use of data processing programs;training relating to data processing;training relating to data processing techniques;training services relating to the operation of data processing apparatus;training services relating to the use of data processing apparatus;tuition in data processing.」及び第42類「Application service provider(ASP)featuring software in the field of fluid flow and heat transfer;computer software consultation;computer software design for others;computer software design,computer programming,or maintenance of computer software;computer software development;consultancy in the field of software design;consultation services in the fields of selection,implementation and use of computer hardware and software systems for others;consulting services in the field of design,selection,implementation and use of computer hardware and software systems for others;customization of computer software;design of computer programs and software relating to aircraft;design,development and implementation of software;development of computer programs recorded on data media(software)designed for use in construction and automated manufacturing(cad/cam);installation of computer software;maintenance of computer software;rental of application software;rental of computers and software;software authoring;technical support services,namely,troubleshooting of computer hardware and software problems;up−dating of computer software;updating of computer software for others.」とされた。

2 原査定の拒絶の理由

原査定は、「本願商標は、登録第4665094号商標(以下「引用商標」という。)と同一又は類似の商標であって同一又は類似の商品について使用をするものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願の指定商品及び指定役務は、前記1のとおり補正された結果、引用商標の指定商品と同一又は類似の商品がすべて削除されたと認められるものである。

その結果、本願の指定役務は、引用商標の指定商品と類似しないものとなったと認められる。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
