指定商品の類似性判断

1 本願商標

本願商標は,「Yumi」の欧文字を横書きしてなり,第3類,第9類,第14類,第18類及び第25類に属する日本国を指定する国際登録において指定された商品を指定商品として,2013年11月7日にEuropean Unionにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し,2014年(平成26年)4月15日に国際商標登録出願されたものである。

その後,指定商品については,平成27年4月6日差出の手続補正書による補正及び2016年(平成28年)10月20日付けで国際登録簿に記録された限定の通報があった結果,最終的に,第9類「Covers and cases made of cloth,leather or imitations of leather or textile materials adapted or shaped to contain hand held computers,tablet computers,electronic notepads,electronic book readers,handheld mobile telephones;spectacles[glasses];sunglasses;cases for spectacle[glasses]and sunglasses.」,第14類「Precious metals,unwrought or semi−wrought;key rings[trinkets or fobs]of precious metal;statues of precious metal;jewellery cases[caskets]of precious metal;boxes of precious metal;ornaments[jewellery,jewelry(Am.)];shoe ornaments of precious metal;jewellery,precious stones;horological and chronometric instruments.」,第18類「Bags;leather,unworked or semi−worked;imitation leather;stirrup leathers;girths of leather;chin straps,of leather,bags[envelopes,pouches]of leather,for packaging;leather leads;bags;tool bags of leather,empty;animal skins,hides;trunks and travelling bags;umbrellas,parasols and walking sticks;whips,harness and saddlery.」及び第25類「Clothing,footwear,headgear.」とされたものである。

2 原査定の拒絶の理由の要点

本願商標は,登録第4267616号商標(以下「引用商標」という。)と類似の商標であって同一又は類似の商品について使用をするものであるから,商標法第4条第1項第11号に該当する。

3 当審の判断

本願商標の指定商品は,前記1のとおり限定された結果,引用商標の指定商品と同一又は類似の商品がすべて削除され,引用商標の指定商品と類似しないものになったと認められる。

したがって,本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は解消した。

その他,本願について拒絶の理由を発見しない。

よって,結論のとおり審決する。
