MESSKOの識別力

1 本願商標

本願商標は、「MESSKO」の文字を横書きしてなり、第9類、第35類ないし第37類、第41類及び第42類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2015年11月16日にEuropean Unionにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2016年(平成28年)4月21日に国際商標登録出願されたものである。その後、本願の指定商品及び指定役務については、原審において2017年(平成29年)8月18日付け手続補正書の提出及び当審において2018年(平成30年)2月1日付けで国際登録簿に記録された限定の通報があった結果、最終的に、第9類「Sensors;computers,computer hardware,computer software;measuring equipment,electrical controlling equipment,monitoring equipment;installations and equipment for conducting,regulating,controlling,monitoring and checking of electrical installation,equipment and devices,of power supply systems,electricity grids,solar modules,photovoltaic installations,wind turbines,wind parks,transformers(electrical),generators(electrical),coils(electrical),capacitors,accumulators,switching devices,tap changers,sensors,electric motors and drives;computer software for influencing,operating,controlling,monitoring and checking of electrical installations,equipment and devices,power supply systems,electricity grids,solar modules,photovotaic installations,wind turbines,wind parks,transformers(electrical),generators(electrical),coils(electrical),capacitors,accumulators,switching devices,tap changers,sensors,electric motors and drives;electrical and electronic control apparatus and instruments,electric monitoring apparatus and computer software for ensuring and improving of the power quality of public,private and industrial power supply systems and electricity grids;sensors for temperature,filling level,flow,speed,acceleration,tension(mechanical),deformation,bending,elongation,shear,torsion,pressure,moisture,surface waves,sound,vibrations,radiation(electromagnetic),light,microwaves,current(electric),voltage(electric),energy(electric),power(electric),impedance(electric),power factor(electric),phase shift and dissolved gas analysis;computer hardware and computer software for evaluating and visualising of data,information and signals,and for controlling of industrial processes;installations,equipment,devices for laboratory use arranged in mobile containers;laboratory furniture;technical,electrical, mechanical,scientific,biological,chemical and physical installations,equipment,devices,instruments and furniture for laboratory use and for stationary,mobile and portable laboratories for biological,chemical and physical examinations and for the examination of oil,machine oil,engine oil,insulating oil,transformer oil,tap changer oil,water,air,gases,insulating materials;laboratory devices and laboratory instruments(non−medical);components and assemblies for the aforesaid goods.」となった。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、登録第3059630号商標及び登録第3304820号商標(以下、これらをまとめて「引用商標」という。)と類似の商標であって、引用商標に係る指定役務と同一又は類似の役務について使用するものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願の指定商品及び指定役務は、上記1のとおりの商品に補正及び限定された結果、引用商標の指定役務と同一又は類似の役務は全て削除され、引用商標の指定役務と類似しないものになった。

したがって、本願商標が商標法第4条第1項第11号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
