指定商品役務の範囲

1 本願商標

本願商標は,別掲のとおりの構成よりなり,第18類,第25類及び第35類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として,2016年(平成28年)5月20日に国際商標登録出願されたものである。

そして,その指定商品及び指定役務については,原審における2017年(平成29年)6月23日及び当審における2018年(平成30年)10月4日付けで国際登録簿に記録された限定の通報があった結果,最終的に,第18類「Leather and imitations of leather;animal skins,hides;trunks and travelling bags;bags of leather,eco−leather,imitation leather,plastic or textile,including bags,handbags,shoulder bags,overnight bags,key cases,chain mail purses,not of precious metal,holdalls,gentlemen’s handbags,make−up bags,travelling bags,shopping bags,wheeled shopping bags,travelling sets(leatherware),vanity cases(not fitted);bags for footwear and multi−purpose sports bags,waistpacks,rucksacks,vanity cases,all of leather,imitation leather and/or textile;garment bags for travel of leather and eco−leather,key cases,key cases of leather;purses,document cases,pocket wallets,card cases(notecases),business card holders,all being of leather,imitation leather,eco−leather and/or textile;hat boxes of leather,cases of leather or leatherboard;leather lining for boots and shoes(unworked or semi−worked);umbrellas,big umbrellas and walking sticks;whips,harness and saddlery.」,第25類「Clothing for men,women and children of any kind of textile or material,including skirts,trousers,shorts,jeans,shirts,blouses,jerseys,sweaters,tee−shirts,vests,suits,tracksuits,coats,overcoats,coats,bomber jackets,jackets,wind−resistant jackets,waterproof clothing,parkas,stockings,tights,socks,tights,shawls,sashes for wear,scarves,gloves,ties,underwear,babydolls being nightwear,nightshirts,pyjamas,bath robes and bathing costumes;footwear for men,women and children of textile,leather,imitations of leather and any other material,including sandals,bath sandals,bath slippers,boots,functional boots and boots for everyday wear,moccasins and slippers,slippers,gym shoes,beach shoes,sports footwear,dance shoes,leisure footwear,soles for footwear,parts for footwear,not included in other classes,components for footwear,not included in other classes;hats and berets,caps,sun visors;waist belts.」及び第35類「Retailing and wholesaling services,including via the internet,of trunks and travelling bags,bags of leather,handbags,walking bags,shoulder bags,overnight bags,key purses,chain mail purses,not of precious metal,tote bags,pouches,make−up bags,travel bags,shopping bags,wheeled shopping bags,travel sets(leatherware),toilet cases,sold empty,bags for footwear and multi−purpose bags for sports,belt bags,backpacks,beauty cases,all of the aforesaid of leather,imitation leather and/or textile,garment bags for travel of leather and eco−leather,key cases,change purses,document holders,pocket wallets,card cases,business card holders,pocket wallets,all of the aforesaid of leather,imitation leather,eco−leather and/or textile,leather coverings for boots and shoes,umbrellas and parasols,walking sticks;retailing and wholesaling services,including via the internet,of clothing for men,women and children of any kind of fabric or material,including skirts,trousers,shorts,jeans,shirts,blouses,jerseys,sweaters,t−shirts,vests,combinations(clothing),tracksuits,cloaks,coats,tunics,topcoats,blousons,military jackets,jackets,windcheaters,waterproof clothing,parkas,stockings,tights,socks,body stockings,shawls,scarves,headscarves,gloves,neckties,underwear,baby−doll nightdresses,nightshirts,pyjamas,bath robes and bathing suits,footwear for men,women and children of fabric,leather,imitation leather or any other material,including sandals,bath sandals,bath slippers,heavy−duty boots and ankle boots,moccasins and slip−on shoes,slippers,gymnastic shoes,beach shoes,sports shoes,dance shoes,leisure footwear,overshoes,soles for footwear,hats and berets,headgear for wear,sun visors,belts for wear;auctioneering provided on the internet;office functions(provided by others).」となったものである。

2 原査定の拒絶の理由

原査定は,次の(1)及び(2)のとおり,認定,判断し,本願を拒絶したものである。

(1)本願商標は,本願において指定している小売等役務(商標法第2条第2項に規定する役務)は,全く業種が異なり,類似の関係にもないものであるため,出願人が出願に係る商標をこれらの指定した小売等役務のいずれにも使用しているか又は近い将来使用をすることについて疑義があるため,商標法第3条第1項柱書の要件を具備しない。

(2)本願商標は,登録第5494823号商標(以下「引用商標」という。)と類似の商標であって,その指定役務と類似の役務について使用をするものであるから,商標法第4条第1項第11号に該当する。

3 当審の判断

本願の指定役務は,前記1のとおり,当審における限定の結果,商標の使用又は使用の意思があることについての疑義がなくなったものと認められる。したがって,本願商標は,商標法第3条第1項柱書の要件を具備するものとなった。

また,本願の指定役務は,前記1のとおり,当審における限定の結果,引用商標の指定役務と同一又は類似の役務は全て削除され,その結果,本願の指定商品及び指定役務は,引用商標の指定役務と類似しないものになった。

以上のとおり,本願を拒絶した原査定の拒絶の理由は,全て解消した。

その他,本願について拒絶の理由を発見しない。

よって,結論のとおり審決する。
