SHADOW BOXERの識別力

1 本願商標

本願商標は、「SHADOW BOXER」の欧文字を書してなり、国際登録において指定された第9類、第16類、第25類、第28類及び第41類に属する国際登録において指定された商品及び役務を指定商品及び指定役務として、2006年2月22日に国際登録されたものである。

その後、指定商品及び指定役務については、原審における平成19年9月10日付け手続補正書により、第9類「Cinematographic films;motion picture films made for television;pre−recorded audio tapes;compact discs;computer games in the form of cartridges,tapes,software;video games in the form of cartridges,tapes,software;CD−ROMs;weight loss computer software programs;pre−recorded video tapes;photographic cameras;time recording apparatus;heart rate monitors for fitness training,sports and recreational use;goggles for sports;protective helmets for sports;DVDs.」、第16類「Printed matter and publications;periodical publications,newspapers,magazines,journals,books,programme guides,programmes(printed);photographs;posters;stationery;instructional and teaching materials(except apparatus);weight loss program books and workbooks;brochures;paper,boxes of paper,table cloths of paper,table napkins of paper,cardboard and cardboard articles.」、第25類「Clothing,footwear,headgear.」、第28類「Games and playthings;boxing equipment including all protective gear associated with the sport of boxing and kickboxing;gymnastic and sporting articles included in this class;body building apparatus;body training apparatus;chest expanders;exercisers;gloves;fitness apparatus;playing cards.」及び第41類「Entertainment services;arranging,conducting and organising sporting activities;organisation of sports competitions;television entertainment;group training in specialised and structured exercise and boxing self defence skills;instructional teaching services for aerobics;providing aerobic fitness classes using boxing techniques;provision of weight loss training programs;instructional,educational and entertainment services in the field of sports and physical fitness including coaching services,training services,the provision of sporting facilities;the management of sporting facilities;the organisation,administration and conduct of sporting events and competitions;holiday and sporting camp services;publication services;production of films,videos,radio and television programmes;rental of sporting facilities.」と補正されたものである。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、登録第2136187号商標(以下「引用商標」という。)と称呼上類似の商標であって、同一又は類似の商品について使用するものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

引用商標の商標権は、商標登録原簿の記載によれば、商標法第50条の規定に基づく取消審判の請求(審判2008−300438)があった結果、その指定商品中「被服(運動用特殊被服を除く)」については、その登録を取り消す旨の審決がなされ、確定審決の登録が平成21年6月23日にされていることが認められる。

してみれば、本願商標の指定商品は、引用商標の指定商品とは類似しないものになったと認められるものである。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
