既登録商標との混同

1 本願商標

本願商標は、「DAKO TRUE POSITIVE ID」の欧文字を横書きしてなり、第1類、第5類、第9類、第10類、第37類、第41類、第42類及び第44類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として、2007年7月27日にDenmarkにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2008年(平成20年)1月25日に国際商標登録出願されたものである。

その後、指定商品及び指定役務については、平成21年4月24日付けの手続補正書、2010年12月22日に国際登録簿に記録された限定の通報があった結果、最終的に、第9類「Diagnostic apparatus and instruments,not for medical purposes,including apparatus for staining and/or visualisation of tissue or cell based samples for diagnostic or scientific use;apparatus for detection of tissue and/or cell based samples and scientific apparatus for high speed cell and/or bead sorting and analysis;recorded and downloadable computer software,recorded and downloadable bioinformatics−enabled diagnostic software;analysis apparatus for laboratory use;measuring apparatus not for medical use.」、第10類「Diagnostic apparatus and instruments for medical use,including apparatus for staining and/or visualisation of tissue or cell based samples for diagnostic or medical use;apparatus for detection of tissue and/or cell based samples and apparatus for high speed cell and/or bead sorting and analysis,all for medical purposes;medical analysis and medical measuring apparatus.」、第37類「Installation and integration of medical instruments,including with existing hospital and laboratory infrastructure;maintenance and servicing in connection with updating and upgrading of medical instruments;all for use in connection with medical analysis,diagnosis and research.」、第41類「Education and training;training in use of medical instruments and computer software.」、第42類「Medical research;installation and integration of computer software,including with existing hospital and laboratory infrastructure;maintenance,servicing,updating and upgrading of computer software;all for use in connection with medical analysis,diagnosis and research.」及び第44類「Medical services;health care;veterinary services,including medical analysis and diagnosis.」とされたものである。

2 原査定の拒絶の理由

原査定において、本願商標が商標法第4条第1項第11号に該当するとして拒絶の理由に引用した登録商標は、以下の(1)及び(2)のとおりである。

(1)登録第2202102号商標は、「ダコ 1000」の文字を横書きしてなり、昭和62年9月18日に登録出願され、第1類に属する商標登録原簿記載のとおりの商品を指定商品として、平成2年1月30日に設定登録され、その後、商標権の存続期間の更新登録がなされ、さらに、平成22年4月7日に指定商品を第5類「薬剤」とする書換登録がなされたものである。

(2)登録第2713797号商標は、「DAKO」の欧文字及び「ダコ」の片仮名文字を二段に書してなり、平成元年12月13日に登録出願され、第1類に属する商標登録原簿記載のとおりの商品を指定商品として、平成8年5月31日に設定登録され、その後、商標権の存続期間の更新登録がなされ、さらに、平成19年9月12日に指定商品を第5類「薬剤」とする書換登録がなされたものである。(以下、一括して「引用商標」という。)

3 当審の判断

本願商標の指定商品及び指定役務については、前記1のとおり補正及び限定された結果、引用商標の指定商品と同一又は類似の商品については、すべて削除されたと認められ、その結果、本願商標の指定商品は、引用商標の指定商品と類似しない商品になったと認められるものである。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は、解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
