指定商品の範囲

1 本願商標

本願商標は、別掲のとおりの構成からなり、第6類、第7類及び第9類に属する日本国を指定する国際登録において指定された商品を指定商品として、2008年(平成20年)2月20日に国際商標登録出願されたものである。

その後、指定商品については、原審における平成21年7月2日付けの手続補正書により、第6類「Locks (other than electric) of metal;metal cylinder locks;padlocks,keys,door hinges of metal,metallic gates,doors and shutters of metal;door handles of metal,anti−panic handles,non−electric door closers,non−electric door openers,hinges of metal,armoured doors,bolts,bolts (locks),closures of metal for containers,doors of metal,door fittings of metal,door knockers,non−electric door springs,stops of metal,knobs of metal,latches of metal,locks of metal for vehicles,metal chains for use with key rings,pins (hardware),spring locks,door stops of metal,window stops of metal;common metals and their alloys;metal building materials;transportable buildings of metal;materials of metal for railway tracks;non−electric cables and wires of common metal;bolts of metal;bottle caps of metal;buckles of common metal (hardware);pipes and tubes of metal;safes;pipes of metal;metal materials for building or construction;metal joinery fittings;metal hardware;prefabricated building assembly kits of metal.」及び第9類「Electric locks,electrical and electronic apparatus for controlling doors and gates,radio controllers,transmitters,video cameras,safety devices,namely electric locks,electric apparatus for use in operating gates,shutters and doors;electric door closers,electric door openers,encoded cards,magnetic encoders,magnets;apparatus and instruments for scientific research in laboratories;nautical,surveying,photographic,cinematographic,optical and weighing apparatus and instruments;measuring apparatus;luminous or mechanical signals;electric monitoring apparatus;life−saving apparatus and equipment;teaching apparatus;apparatus and instruments for conducting,switching,transforming,accumulating,regulating or controlling electricity;apparatus for recording,transmission or reproduction of sound or images;magnetic data carriers,recording discs;automatic vending machines and mechanisms for coin−operated apparatus;cash registers,calculating machines and data processing equipment and computers;fire−extinguishing apparatus.」とされた。

2 原査定の拒絶の理由の要点

原査定において、「本願商標はその構成中に、ドイツの都市の名称である『GERA』の文字を有するものであるから、これをその指定商品に使用するときは、ドイツの都市『ゲーラ市』を産地、販売地とする商品であるかのように商品の品質について誤認を生ずるおそれがある。したがって、本願商標は、商標法第4条第1項第16に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願商標は、別掲のとおり、「GERA」の欧文字を黒い太字で書してなり、その末尾に赤い小さな正方形を配してなるところ、その構成中「GERA」の文字に関し、コンサイス外国地名事典<第3版>(三省堂 306頁)によれば、「ドイツ中部、テューリンゲン州東部の都市。ザクセン地方からテューリンゲン地方にかけての伝統的繊維工業地域における中心都市の一つ。」との記載があるとしても、該都市が、本願指定商品中いずれかの商品の生産地又は販売地として一般に知られるほどに、当該商品の製造、販売が行われていると認めるに足りる事実を発見することができなかった。

そうとすると、本願商標構成中の「GERA」の文字は、我が国において、これが直ちに本願指定商品の産地、販売地を表すものとして一般に認識されるものとは認め難いものであるから、これをその指定商品に使用しても、ゲーラ市において生産された商品であるかの如く、商品の品質について誤認を生じさせるおそれはないものである。

したがって、本願商標が商標法第4条第1項第16号に該当するとして本願を拒絶した原査定は、妥当でなく、取り消しを免れない。

その他、政令に定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
