指定役務の補正の適否

1 本願商標

本願商標は、別掲(1)のとおりの構成よりなり、第35類、第36類及び第38類に属する国際登録において指定された役務を指定役務として、2000年6月29日付けFranceにおいてした商標登録出願に基づいて、パリ条約第4条による優先権を主張し、2000年(平成12年)12月28日を国際登録の日とするものである。

そして、その後、指定役務については、平成14年8月9日付けの手続補正書により、次のように補正されたものである。

2 原査定の拒絶の理由(要点)

原査定は、本願商標が商標法第4条第1項第11号に該当するとして、別掲(2)に示した登録第3331936号商標(以下「引用商標」という。)を引用し、本願商標と引用商標とは、共に図形部分も独立して自他商品の識別標識としての機能を有するところ、両商標の図形部分は、全体として極めて酷似したものであって、その構成の軌を一にするものであるから、これを時と処を異にして観察する場合は、外観において相紛れるおそれのある商標である、旨認定、判断して、本願を拒絶したものである。

3 当審の判断

原査定において、本願商標の拒絶の理由に引用した登録商標の商標権は、商標登録原簿の記載に徴すれば、取消審判(2004−30952)により、平成17年7月12日付けで商標登録を取り消すべき旨の審決がなされ、その確定審決の登録が同年12月16日付けでなされているものである。

したがって、本願商標が商標法第4条第1項第11号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
