本願商標の概要

1 本願商標

本願商標は、別掲のとおりの構成よりなり、第9類、第16類、第25類、第28類、第35類、第36類、第37類、第38類、第39類、第41類及び第42類に属する国際登録において指定された商品を指定商品として、2000年(12年)9月18日にドイツ国においてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2001年(平成13年)3月16日を国際登録の日とするものである。

そして、指定商品については、平成14年6月21日提出の手続補正書により、さらに2004年(平成16年)9月23日付け及び2006年(平成18年)6月23日付けで国際登録簿に記録された限定の通報があった結果、第9類「Telecommunication machines and apparatus;capacitors;electric converters;distribution boards(electricity);electric installations for the remote control of industrial operations;optical apparatus and instruments;measuring apparatus;apparatus for recording,transmission,processing and reproduction of sound,image or data;machine run data carriers;data processing equipment and computers.」、第16類「Printed matter,especially stamped and/or printed cards of cardboard or plastic;instruction and teaching material(except apparatus);office requisites(except furniture).」、第25類「Clothing,headgear,footwear.」、第28類「Games and playthings;appliances for gymnastics and sports equipment;gymnastic and sporting articles(included in this class).」、第35類「Data base services,namely operation of data base.」、第36類「Insurance;financial consultancy;financial evaluation[insurance,banking,real estate],financial management;leasing of real estate,real estate agencies;real estate brokers,real estate management.」、第37類「Maintenance and repair of equipment for telecommunication.」、第38類「Telecommunication;operation and rental of equipment for telecommunication,especially for broadcasting and television;collection and provision of news and information,namely wire service.」、第39類「Transport and storage of goods.」、第41類「Entertainment;organization of sports competitions;organization of exhibitions for cultural or educational purposes;presentation of live performance;organization of shows[impresario services];arranging and conducting of seminars;publication and issuing of books,periodicals and further printed matter as well as corresponding electronic media(including CD−ROM and CD−I).」及び第42類「Rental services relating to data processing equipment and computers.」とされたものである。

2 原査定の拒絶の理由の要点

本願商標が、商標法第4条第1項第11号に該当するとして、本願の拒絶の理由に引用した登録第4166085号商標(以下「引用商標」という。)は、「TCOM」の欧文字を書してなり、平成8年9月19日に登録出願、第37類「電気工事,電気通信工事」を指定役務として、平成10年7月10日に設定登録されたものである。

3 当審の判断

本願商標は、その指定商品及び指定役務について前記1のとおり補正及び限定の通報がされた結果、引用商標の指定役務と同一又は類似の商品及び役務は、すべて削除されたと認められるものである。

その結果、本願商標の指定商品及び指定役務は、引用商標の指定商品と類似しない商品及び役務になったと認められるものである。

したがって、本願商標が商標法第4条第1項第11号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

その他、政令で定める期間内に本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
