VERIOXの識別力

1 本願商標

本願商標は、「VERIOX」の欧文字を横書きしてなり、第5類及び第10類に属する日本国を指定する国際登録において指定された商品を指定商品として、2013年3月27日にアメリカ合衆国においてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2013年(平成25年)9月25日に国際商標登録出願されたものである。

その後、本願の指定商品については、当審における2015年(平成27年)7月22日付け及び同年11月6日付けで国際登録簿に記録された限定の通報があった結果、最終的に、第5類「All−purpose disinfectants for medical instruments,healthcare facility surfaces,and for coating medical bandages;irrigation solutions,namely,medical cleansers for wounds;coatings for surgical implants and medical devices,namely,antimicrobial coatings to prevent the growth of viruses,bacteria,spores,biofilms and fungus on various surfaces;antibacterial creams and ointments for use in dental procedures;all−purpose disinfectants;ingredients for antimicrobial preparations for treating;inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;ingredients for antimicrobial coatings to treat,inhibit and prevent the growth of viruses,fungus,mold,bacteria,spores and biofilms on various surfaces;ingredients for biostatic antimicrobial preparations for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;ingredients for antimicrobial creams and ointments for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;ingredients for irrigation solutions,namely medical cleansers for wounds;antimicrobial preparations for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;antimicrobial coatings to treat,inhibit and prevent the growth of viruses,fungus,mold,bacteria,spores and biofilms on various surfaces;biostatic antimicrobial preparations for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;antimicrobial creams and ointments for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms;antimicrobial creams and ointments for treating,inhibiting and preventing viruses,fungus,mold,bacteria,spores and biofilms for use in dental procedures;microfiber towels impregnated with an antimicrobial treatment;surgical implants impregnated with an antimicrobial treatment.」及び第10類「Medical devices coated with an antimicrobial treatment;surgical implants coated with an antimicrobial treatment.」とされたものである。

2 原査定の拒絶の理由の要点

原査定は、「本願商標は、登録第5385570号商標と同一又は類似の商標であって、その商標登録に係る指定商品と同一又は類似の商品について使用するものであるから、商標法第4条第1項第11号に該当する。」旨認定、判断し、本願を拒絶したものである。

3 当審の判断

本願は、その指定商品について前記1のとおり限定の通報があった結果、引用商標の指定商品と同一又は類似する商品がすべて削除されたと認められるものである。

その結果、本願の指定商品は、引用商標の指定商品と類似しない商品となった。

したがって、本願商標が商標法第4条第1項第11号に該当するとした原査定の拒絶の理由は、解消した。

その他、本願について拒絶の理由を発見しない。

よって、結論のとおり審決する。
